Q: After 4 years of service my boss is making my school transfer hard

Merry Christmas everyone,

     well 2 days ago I finished my 4th year with my school. Due to the 5 year rule, I have had to find a new job. All was great a leaving party and eveything, Promises of no problems with my release letter and documents. Slowly things are turning bad. Now he is saying he will only give me the documents once I have let him cancel my residency permit. My new school have told me not to allow him to do this. I would have to leave China. I can see things getting very nasty ( no employee (Chinese or foreign) have ever left this company with what they are due. I thought I was different and he actually liked me. I have seen the release letter and recommendation letter, We are just waiting for the cancelation letter from my foreign expert certificate. I know there will be problems coming. My plan of action is to contact the SAFEA and the PSB (poilce security Bereau , Be very polite and just ask for advice. If any of you have any ideas please let me know. I have new for many years when I left it would be a massive f.... up. Cheers

Hi everyone,

                     wow it was a crazy few weeks for those who followed this story. I appreciate all the help you gave me. What has happened since I last posted is.

I had to cancel the residency permit, I am in He nan province(not the capital) and the police here will demand you cancel the residency permit if they know you are leaving the school. I have been given 15 days to leave China. ( I tried for 30 days but  the school chooses).

   So no choice but to go through the Z visa again. I needed a Criminal record check from the UK. A scanned copy was good enough. I got this within 7 days of applying. So now my Z visa will be ready in 14 days, but my residency permit extension expires in maybe 10 days. So a short vacation in Hong Kong is ahead of me. I start my new job on February 4th.

   Just waiting for payment and the useless release and recommendation letters etc etc.etc, I will keep them as souvenirs.

 

I can help with anyone needing a UK criminal record check too. I will make a separate thread on how to do this. It was very very easy to do.

The Q is 'why did you terminate the Contract/leave the school' and since you wrote 'the school chooses', you terminate it without School's Contract breach, i.e. 'valid reason'.

 

If you terminate the Contract because of employers breach/Contract disrespect, PSB should give you 30-days RP extension, so your new employer can get new FEC and change records at PSB of your new RP sponsor. No China exit required!

If you would listen my advice and call SAFEA, that RP termination and 15-days exit visa wouldn't happened.

I was in Kaifeng, Henan and I resigned with immediate Contract termination, because employer was 'too busy to make my working schedule in the beginning of 2nd Semester', i.e. ' employer's Contract breach'. I was free of work for 30-days, nagging employer twice a week for the time-table.

Then, I found new job, resigned and got both documents (RL and FEC cancel cert.) and my new employer in Guizhou extended my RP, which wasn't canceled in Kaifeng. I also get Recommendation letter out of Kaifeng Uni.

Call to SAFEA assured, I received full pay for 30-days of not working, RL and FEC Cancel cert. Year 2016, April.

Name and shame please. And post it as a question headed with the school's name so it turn up in search results.

There was no termination of contract it expired. The Foreign Expert Bereau  helped a lot. They called my boss and made him explain everything to me. Now my Chinese is not very good, but I understood what was happening at the police station. I was demanding 30 days stay on my residency permit and waving the contract at the policewomen and showing her my new job offer from my new school. She rang the PSB policeman who said it can only be decided by my school. My boss called me and said he had to ask for 15 days the policeman wanted to give me 10 days.

    The police have cracked down hard on the schools recently here. From what I seen the other day cancelling my residency permit. It was the policeman who was making it difficult. I even heard him telling the school manager that next time it can't be 15 days it has to be 10.

    This is all very stupid because no one will ever come to work in this province. So if you work in He nan there will be no way of changing jobs. Even a school to school in the same province. The same company too . Maybe this is all nonsense. It just doesn't make sense.

     Really if I understand it correctly. You/your school  never need to tell the PSB you are leaving, just move and transfer residency permits. If the police find out they can make it very awkward for you . And in this city/province that is what they are saying they are going to do.

    In the end my new school, just said do what they want. They are blaming my old boss for telling the PSB it is a stab in the back for me.

     I am still unsure of how and why things worked out this way.....

I do have another problem lol ..... I have never done the z visa in Hong Kong dash..... Any good links on here ....

That thingy with police (PSB) requirement of RP cancellation is new to me. If I would be in your shoes, I would call SAFEA, before RP cancellation and make sure about my options, i.e. 'how long extension I should receive'.

Consider yourself lucky, because you can get new Z in HK. I had to travel to EU for new Z out of Henan in 2013, where I arrived with 30-days S2 visa given as an RP extension, but my employer (Public School) just filled for 'laowai hire authorization' and I had to return home for new Z. School paid for the trip thou, hahah

 

Think about 2-3 weeks HK stay at least, if you aren't traveling there with Invitation letter and Working permit from your new employer.

 

You'll need both docs. to apply for Z and both docs. must be in original form, not emailed. It must be sent by mail to your HK hotel.

You'll need few photos and Z visa form, which must be filled over the puter. No hand-writing is permitted on the form. 

Pay attention, how you'll fill-up the form, because you'll get rejected and then you must redo all form in shop with computer and printer.

It use to be huge queue line in front of the Chinese Embassy, so again, 'pay attention how you'll fill the Z visa application form'.

 

Mong Kok in Kowloon is the area with cheap motels. See Nathan Rd., L side if you're heading toward the sea.

Chinese Embassy is in Wan Chai, where you can cross the water with ferry. Some 10-15' trip, cost HK 3.5, I think. There's also underground, but I fancy boats more.

in shanghai, Police check needs to be certified by FCO from UK then Chinese Embassy in the UK before it will be accept in China. Same with the degree.....

 

The government is really making things diffcult.
