Q: ANY ONE CARES ?

There are a few things about China that evidently I dislike, but I do try to ignore them since what for them is "normal behavior", for me it is not, and they are more than me, of course.

But something happened yesterday that did bother me at the beginning, and really angered me at the end. There is a local supermarket where I live called B & H, or Better & Home according to the logo at the entrance. Well, I visited them and purchased 4 ea containers of milk. When I arrived home, I opened one, and milk was not coming out, it was coagulated almost solid inside, and quite a bad smell. Only then I noticed that the expiration date was 2017/01/12.

So, got my "fapiao" (receipt), the 4 containers of milk and went back to the store, since all 4 of them had the same expiration date. At the store, after a long heated argument, they refused to return my money because they claimed "I was not force to buy them". I had picked them up, so it was my fault, not theirs. And will not exchange them, because every container of milk they had in stock had the same expiration date.

Now, I normally go there because it is the one closer to me, and spend around 200 to 300 Rmb about twice per week in groceries. I asked them if it was good policy to loose a good customer for 40 lousy Rmb the milk was worth. Their answer was priceless, "there are 1.8 billion Chinese out there, one customer means nothing to us". I can put up with people spitting or pissing on the street, picking their noses in public, and many other things by just looking away. But selling expired milk knowingly, that is beyond the "ignore" stage, borders on being a greedy SOB.

And to those who may care, do not buy milk containers without checking the expiration date, I have learned my lesson. And to those who do not care, have a cold one on me.

Actually - yes, according to Chinese consumer law, they are legally obliged to ensure all of their products sold meet health and safety requirements, and give a refund if defective.. As per Articles 18, 19, 20, 23, 24, 26 Of the People's Republic of China Law on Protection of the Rights and Interests of Consumer, Number 7, Chapter 3, 2013.

 

As per Section 40 - you may demand compensation... both for their failing to show the product was unsafe, and also because they didn't bother to refund or exchange.

Happy, you've been here for years... I'm pretty sure you could find appropriate peoples to scare the fuck out of them, and beg to apologise and refund you...

Option B, of course, is do it all over again, but video it in secret....

There are people you are supposed to contact , call and they'll never answer eventually taking the phone off the hook, walk in they'll put you on the phone w/ sb in charge who'll tell you you need to go to another dept. because they don;'t handle it, and they 'll either not tell you the dept. or give you a dept who'll then do the same thing until you're running around in circles.

TIC on 'no exchanging the item worth 20 RMB  ...'

 

I always check the expiration date on milk and best/freshest milk is in 'behind' shell's part, not in 'front' 

 

They don't have 'exchange-thingy' in China. Once you purchase it, you own it!

 

I bought small nail clipper once for 10 RMB on some Railway station in China. Then, I tried it on my nails and it was too small. I went back and try to exchange it and add price difference, but I walked away with two nail clippers for some 25 Rmb .... one for each hand ...

well the expiration date is also not really an indicator here.

You will find that the freshest milk is from today and lasts till tomorrow, not exactly helpful.

These psychos tasted their first blood with the cultural revolution and CCP keeps brainwashing them with every propaganda trick they can think of.

 

Rest assure they know and remember you, they are super duper gossipers. Give them the best punishment, no business ever again. A month or two later, if you ever bump into those low lives on the streets again, you will see them darken their ugly faces when they spot you. The big supermarkets are slightly better.

You should have done what I did, secretly video the conversation then play it back to them. Go a second time and try. In China you've got to embarrass them. Notice, I said embarass not threaten to embarass them, you can also contact the police. Be sure to also have your wife secretly video the milk on the shelves.

Learn your lesson and do what I do, shop only at foreign shops (rt, tesco, walmart metro)

If your Chinese is good enough I suggest shaming the supermarket on Chinese social medias, notably on Weibo, there are groups and hashtags existing specifically for this king of thing, if you scream loud enough it will get viral and people will start boycotting the place. You may not get your money back but you will have your revenge.

Be careful of doing that without absolute undeniable video evidence because they can come back at you with a liable lawsuit and remember foreigners are fucked in courts here
