I mean this school hasn't issued me with the foreign expert certificate nor the residency permit yet; and it looks like it's about to run out of business.

Applying for FEC online ???
Correct me if i'm wrong, but isn't this issued at the same time as the RP and both are collected from the PSB at the same time, as icnif77 points out, (with the passport).
for someone who claims to have FEC cancelation letter and release letter from previous employer it sounds a bit off.
Also, having a RP valid for so far in the future without an employer (for a teacher) does not sound right: you say you have a valid RP for next June.
Any teacher i have ever met, their RP becomes invalid/finished close to the termination date of their contract unless there is a renewal/extension from the same employer, so there is also a new contract.
i know this sounds picky, but there has been SO much trolling on this topic it is like we are being tested on our responses to detect any approval for illegal behavior.
icnif77:
School can apply for FEC and WPermit online. School, not FT.
PSB will grant RPermit exactly till the expiration of the Contract. Some Schools (my present one) are offering info about Contract renewal 30-60 days before the expiration of present Contract.
I am a little confused here. You say that currently you have no FEC and RP. Does that mean you have arrived on a 'Z' visa and you are waiting for the RP? Or does it mean you haven't even got a 'Z' visa and thus arrived on some other kind of visa? If it's the latter, then don't worry about it. There is no legally binding contract. You may have signed a contract but it has no legal status. If you have arrived on a 'Z' visa, take the matter up immediately with the local SAFEA office as you only have 30 days to get the RP. If you overstay that period, you have liability yourself and may end up paying a fine.
As far as the official system is concerned, you haven't signed anything until the Labor Bureau (or SAFEA) has seen, accepted and stored a copy of it.
In clear terms: no FEC = no contract.
If you think your school isn't dealing with your paperwork, now is the time to go to the SAFEA. You risk nothing at this point.
icnif77:
Correct!
'Contract is not valid, till we don't issue FEC!' wording of Jiangsu SAFEA officer in June 2014.
Most schools will try to hold the FEC as a mean to pressure you if you want to quit, if you don't know about it they will never tell you about it, if you ask about it they will say they have to keep it according to the law, if you know the law they will say it's for your safety.
Now the law says that only the foreign expert (you, the teacher) is authorized to keep the FEC booklet, if they keep it this is illegal, they can keep a copy of it but not the original, otherwise tell them that you will contact the Foreign Affairs Bureau aka. SAFEA and if they laugh at it "lol we have good guanxi" then do it and have a laugh because all their connections won't help them against the SAFEA.
Make sure you keep us updated on the details so we know how this turns out.
Thank you so much for the replies guys.
Yep, I've got the FEC cancelation letter + the release letter and a residency permit that's still valid tiil June of next year, but they were all issued to me by my previous employer.
Another thing though... This current school that I've just signed with told me that they're going to apply my FEC online. While they do have photo copies of my passport, release letters, FEC cancelation, and photos; they do not have the real documents on hand.
So.. yep.. based on all of these, do you guys think I still can do the "midnight run"?

I want to point this out to all the other members. 5 posts 200 points. There is another account with similar stats. So we have a clue as to our anon troll poster account.

You're right but if it is thumbed up maybe. can someone quickly thumb up my test Anon post.
School cannot get/give you RPermit and FEC in a week. It takes somewhere from 2 -3 weeks to get both documents from PSB and SAFEA.
icnif77:
Since May 3rd, 2014, when I completed Contract in Xinjiang, I will apply 2nd time for Z visa, and I am at the 3rd different school, which signed Contract with me without having 'Foreigners hire authorization'. They burned my valid RP/S2 visa in the process, because they couldn't get 'laowai hire authorization', before my RP/S2 expired.
3rd different employer in 4 months time.
I didn't violate Contract (quit) with any of the three previous employers. 2nd School in Fujian dismissed me with no cause. I left School with Release letter (and SAFEA's help), but I will look into the matter with help of Chinese lawyer. I'm sick of this BS!
Anon posts do not get points so I assume it could be from logging in. If I'm wrong, my apologies but this still seems made up to me. Going out of business and paying all that money to hire a foreign teacher legally.
