Q: Can I get a new Z visa while having a valid residence permit?

I've  asked for contract termination.My  employer refuses to terminate the contract,unless I pay a breach penalty.Obviusly,I'm not willing to do that.I've already found a new school in an other province and they got the work permit and invitation letter for a new Z visa.Can I just leave my current employer,go back to my home country and apply for a new Z visa with a valid residence permit in my passport?

nope you can not. 

 

until you get the cancelation of the work permit then you can apply for the resident permit in other province

Your current employer will terminate the contract... they don't have much choice! You go away, they don't have an employee, they 'cancel' the contract, and cancel your Z visa in the process.. which will turn into a 30 day L visa (in which you are supposed to leave the country).

 

If your new employer has the guanxi, you get yourself a new visa and permit painlessly. If they don't have the guanxi, you will need to leave the country (HK being the most obvious, but I've been hearing that's not working so well now).

 

You will need to get a release letter from your current employer - who will be quite unwilling, but legally required - to provide one!

 

Also, you need to understand that each province will have their own rules and requirements...
