Q: Can they cancel your visa or only your work permit?

From my current company, I was told they will cancel the visa after I resign, and could get a one month extension to tie ends up here. The new company says that its not a problem because they can only cancel your work permit, and your residence permit remains valid... anyone have any experience with this?

Get your new company to sort it out with the PSB

they think they know what is what

so make them put their money and time where their mouth is

Assuming you are referring to a work visa, that visa was good for 30 days after you entered China, then expired and was replaced by your residence permit.  So, no one can cancel it again !.

Now, your work permit is tied and valid only for your employer. It is no good at all if you change employer, must get a new one issued with the name of the new employer. Your existing employer can not cancel it, only PSB can when either you or them tell PSB that you resigned. Then, you will be given 30 days to get a new job, and process the paperwork, or leave the country.

And last, sinc you entered China with a work visa, your residence permit is valid for as long as you work for the employer who originally hired you. If you resigned, as I said above, you get from PSB 30 days stay to either get a new job or leave the country.

Hope that helps you sort out the confusing issues facing you.

PS: If you do not get a new employer within 10 days after resigning and your work permit cancelled, then whenever you get one you will need a new work visa instead of just a change of employer names at PSB.

Only Work Permit can be cancelled..Your Visa will remain valid..wirhter you do any job or not..you can stay in China
