Q: Cheated by landlord! What to do? Who to contact?

Dear all!

 

Long story short:

 

>Rented an apartment in Jingan (2600 as deposit, 5200 as 2 months rent)

>Lived there for one week and moved out

>I agree to leave the deposit as compensation (as mentioned in the contract)

>Landlord agrees to pay back 5200 (2 months rent)

>Landlord rents out apartment again and keeps delaying returning my money since 2 weeks

 

Do you have any idea what to do? Who to contact in this case? I called the police already and had them come to his office. He agreed to pay the next day and delayed again. "No money".

 

Your suggestions are greatly appreciated!

If you have a contract, to to the local Public Safety Bureau. If your Chinese language ability is not up to snuff, bring a friend along.

One of the things the landlord will do is to wear you down, hoping that eventually you will forget the debt.  Every time you get him to the Police, PBS, or whatever, he will say he will pay soon, but has no money now.  Police will accept that as a satisfactory answer, and will not do anything else for you.  

I do hope I am wrong, actually it will make me very happy to know you got your 5200 yuan back.  But I do not want either to give you false hopes.  I have see variations of this many times, and the only way I got some satisfaction back was thru the use of some of my Gf friends, they can be very convincing sometimes.  Not right, but done by many here.

To threat someone is NEVER legal. However, you can try to "aggressively convince" them.

Happy is correct and also this happens in small claims court as well. When i opened my company I was told I was able to register the license, after sometime we found out the landlord wasn't lying, instead the tenant before refused to give up the address, I took him to court, the last tenant had to pay my loss and remove his address from the license, the last tenant said he would and the judge gave me permission to continue until address could be registered. 4 months later guess what, last tenant still is using the address.

do not expect you can get the money back , i  rent a house near garden hotel  and paid three month rent for it , after spent one day in the house i moved out , i only asked  one month money back , the landlord refused ,  i went to the community managment office for help , they sent me to police station , then i wen to the police station , the police station sent  me to the Justice Bureau .  the Justice Bureau  then sent me to the community managment  office again         i was very disappointed . i have to say some  officials are  talking nice , but they just  mutual shirk responsibility and can not  solve the problem for you .
