Q: difficulty in asking for a contract

I was offered a job outside of teaching. I get the feeling that the owner of the company is a decent honest guy. Problem is his English is not good. His written English is even worse. I asked for a contract written in Chinese and English and he has been slow to get it to me. I get the feeling it is difficult for him to do and he doesn't see why it is necessary. Do Chinese understand the importance of contracts. Should I cut him some slack since it is non teaching

I never ask for Contract at part-time job. However, I demand prompt pay. At Kindies part-time and tutoring, I must be paid every week.

Get Chinese translator, write your own Contract, and show it to your part-time boss.

What's the job? I know a guy who worked a job for over a month on a word of mouth agreement and then got nothing in return. But a company that can't provide a contract doesn't sound like a company that can provide a work visa.

dokken:

it was as an athletics coach. so it kind of was teaching I guess. I ve got my coaching badges i did at university

he's not responding now i asked for a contract. was too good to be true. china is so frustrating. its not that hard a process to get me visa and give me a contract is it?

hi2u:

Well getting a new work visa with a new company requires you going back to your country to apply, and your company needs to prepare all the documents to apply, like invitation letter, some legal documents for the company, etc. And you need to go through some process of canceling the foreign expert certificate for teaching English because it's in a different field or something like that. My company's HR gave me all the necessary documents and did most of the leg work for me so your company should probably do the same.

I can't open 'comment' for some reason.

If he'll sponsor your RP, he must show signed Contract to SAFEA. You could ask for advice on Contract at SAFEA.

They have Chinese English speaker anywhere I called them.

Do you understand China? Sounds to me it is not a legit job. Meaning, you are working part time or for a company not tied to your visa. Either way a contract is useless and will only serve to incriminate them and you.

An illegal  contract does not mean anything, you do not have to follow it neither do they.

So do you understand that you are in China?

dokken:

It is full time. Why would visa not be tied to the job. I don't understand. Why would job not be legit

Because you need a signed contract to get the work visa. So if you do not have a contract then you can't get the visa. Can you understand it?

Strangely I got a  z visa before and I never signed a contract. I worked for my best mate and his chinese wife. They had opened a school. The job was last minute so I never did things as they should have been done.

You can't get Z without WP. For WP, school needs signed Contract. 'porky pies'?

I'm not lying. not sure how my friend did it, but i never signed a contract and i got a zvisa  a couple of months after coming to china. in the beginningi  stayed in china with holiday visa. a couple of months later i got a z visa. i didnt need to leave country but just get a medical check in shanghai. my boss had contacts i guess. my boss was a friend, a very good friend since school and i guess i gave him more flexibility than i should have. as englteached will no doubt say i should have been less ignorant of the visa process. but it'sin the past.

another question; can a small company just as easily get you a z visa or is only large companies that can do it?

icnif77:

You cannot get Z in China. The closest to China you can get Z is HK, but that's considered an 'exit/out of China'.----->Chinese law!

You can get F in China, without medical exam.

Z visa must be replaced by RPermit in 30-days after your entry to China (stamp in your passport). RP validity (usually) match validity of signed Contract.----->Chinese law!

As I know, any Co. (school) must be authorised by Chinese Gov. to hire 'laowai'. If Co. has authorisation, it can sponsor Z and RP later. Size of the Co. doesn't matter.------->Chinese law!

You should know, since you have one. You cannot get Z visa in China! You must exit China and apply for Z in Chinese Embassy with Invitation letter and Working permit.

Engl will have headache tomorrow reading replies here.

You need at least one z visa in your passport to have a working RP. You can get a family RP without leaving your country. What does your RP say is reason for your stay ?

Unless, of course, you got your original work RP before they changed the law about leaving China to get Z visa. Anyone know when that was?

i swear on my life i arrived in china with a holiday visa. then i had to go to shanghai twice. one to some kind of visa agency and they took me to a government visa type place (psb?), then i went a 2nd time to get health check. i had a valid rp in my passport for shanghai afew weeks after that. my school was not in shanghai but elsewhere so i know it wasnt fully legit.

My 1st Z in 2010. I had F, and had to returned to EU (home) for Z. This law is from long time ago. I've never read anywhere, FT got Z in China. I was even surprised when I read first time about HK Z pick-up. I'm talking about FT's Z. I don't know about other jobs, but if you look at HK Chinese Embassy website, it clearly state, you can't get Z in China.

I'm seeing you all attached to Engl's tits here . Write 'z visa in China' in Yahoo-gle, and you'll see all the requirements.

God's honest truth I came to China on a holiday visa. My boss told me i might have to go to Hong Kong to get visa. But it changed to going to shanghai twice as I said above. So it must be possible in some rare circumstance because I swear I got rp without leaving China. Rp is in my passport. I came on holiday visa

When people start saying I swear on my life or God's honest truth they are typically lying. Especially on internet forums.

A: "... through ..."?  Only "through" comes to mind is "Shenzhen agent can connect you with an employer, who's authorized to hire waigouren ... and can sponsor Z visa." It's not like every 10th person you meet in Shenzhen's hood can sponsor work visa ...  The only way to change from student to labourer visa is just a regular way by: 1. Finding an employer, who'll apply for an Invitation letter; 2. Exit China and apply for Z visa in your home country's Chinese embassy; 3. Enter China in 30-days after Z visa was stamped into your travelling instrument ...As I am aware, you won't be able to switch to Working permit by remaining in China....,so make ready for a return to your home .... -- icnif77
