Q: Do you do Criminal history checks on prospective Employees?

In Australia we have a thing called a Blue card.
without it you can not work with children under 18.
it's not a perfect system however it does help stem the flow of predators from the education industry.
even school bus drivers need to have a blue card.
A check on an Australian can be done on line .
So if you're thinking about hiring an Australian to teach ....ask to see their current blue card .
Any other countries do this?

Not as Ozz, but I believe Schengen countries do it without job applicant's knowledge. Just as a job's requirement, i.e. School most likely check it, before job is granted.

 

I had to show Non-criminal cert. in 2013 in Henan (High school), before I got all docs. for Z visa and now, I have the same file attached to my CV and nobody ask me for the new one.

In the U.K. to work with kids or vulnerable adults you need an enhanced CRB check. This is also required even if you're a volunteer in a kids groups (Scouts, Church youth groups, etc). It's absolutely the right thing to do. There had been too many cases of predators getting involved with kids groups to prey on vulnerable children.

I am an Italian citizen resident in London for over 4 years. In ten 10 days I am relocating to Malta and my new employer (an E-Gaming company) asked me to provide a "police conduct". I told my employer that I am not authorized by law to apply for a CRB check myself but the company has to do it. The employer said I might try to ask the Italian Embassy in London but I do not think they can help me. Do you know how I can sort out my problem? Thanks.

It will take more then 10 days to complete the whole process so I hope starting your new job isn't hinging on receiving this  

You should also point out to your employer if they're not willing to countersign the form then they won't receive a copy of the CRB from the source & they will dependant on you providing an original copy

 

In many other words, you aren't entitled to apply for CRB as an individual. Only employer can.

In the U.K. there are two types of criminal records checks. 

1) A police certificate. This is a standard criminal records check. These are what China requires and can be applied for by the person.

2) A CRB check. These are needed for working with children and vulnerable adults. For these your c&p is correct. The employer applies. This check will tell the employer is you've been banned from working with kids and if you've ever been placed on the sex offenders register. This is the equivalent, as far as I know, to the Australian blue card that Phil refers to.

In other words, 'I don't know about UK requirement, but I found different post (than what you're saying) over the Internet. Maybe difference between your statement is 'UK citizen must provide CRB and Non-UK (EU) can't get it without of support of UK hiring Co.

Same requirement happened to me in China (Henan) and I could get 'Non-crim cert' out of my Gov. without any problems. Even my Bj Embassy could provide me with the same cert.

Who can ask for a DBS check

Only employers and licensing bodies can request a DBS check. Job applicants can’t do a criminal records check on themselves. Instead, they can request a basic disclosure from Disclosure Scotland (you don’t have to be from Scotland to do this).

Use the DBS tool to find out if you can check someone’s criminal record. You can contact DBS if you’re not sure.

How to get a DBS check

  1. The employer gets an application form from DBS or an umbrella body (a registered body that gives access to DBS checks).

  2. The employer gives the applicant the form to fill in and return to them along with documents proving their identity.

  3. The employer sends the completed application form to DBS or their umbrella body.

  4. DBS sends a certificate to the applicant. The employer has to ask the applicant to see the certificate.

If the applicant has subscribed to the DBS update service, the employer can check their certificate online.

You're right there icnif, seems they've changed the system. I last lived in the U.K. >7 years ago and it was a CRB check back then. I learnt something today...that I'll never personally need as I don't teach

Not that I am into the CRB rules, but I 'guessed' in my post, that hiring companies do it without job applicant's knowledge. IMO, everybody does CRB checks except for jobs in chicken nursery, i.e. 'sorting eggs' jobs.

It was also my first time in 2013, to get Non-crim. record for Henan.

In my state, you need to go to a private agency to do a background check each time. Because we're corrupt like that baby. Local police dept are not allowed to give out background checks.

The blue card system is in Queensland (Australia) only, each State has its own procedures. In New South Wales (Australia) you apply online and than approximately 6 weeks later if cleared, are given a unique WWCC (working with children check) number and certificate which you then pass on to your employer.  Applying for  a number to work as a volunteer is cheaper than applying for a number in a paid position, however I believe the checks are the same.  Your unique number is valid for five years, and is monitored by police.  If you initially apply for a volunteer number which is free, you can then apply to do paid work without reapplying, and just pay the processing fee of $80 AUD.  This is not a criminal record clearance, for that you need to apply for a National Police Check which is Australia wide, and costs $50 AUD.  If you really want to impress your future employer get both, or if you want to be sure about your next Australian teacher, ask for both.  This system is designed to protect children, and appears to work.

The trouble is that the most reprehensible people can have no criminal record through luck, circumstance or weasel guile.

 

We have had a string of Canadians all of who had worked previously in different places in China but outted themselves through questionable behaviour on wechat with youngsters. Of course they were fired but there was no follow through as the victims chose not  to complain or report these shitbags. 

 

I assume they have gone off to a new city to reinvent themselves and send cockshots to teenagers there.

I guess the only thing to do is to be aware that this type of scum is lurking about and nip it in the bud when it comes on your radar. Unfortunately due to the culture of face and family shame it will go largely unreported.
