Q: green card application

​according to PSB to be able to apply for green card as being married to a chinese citizen,must have stayed for 5 years here in china and marriage atleast lasted for 5 years.i dont know about the requirements before,there was a year when i went back to my country 2x a year and each time stayed for 59 days meaning 4 months together in a year i was out of china.it said in the reayuirements that at least 9moths of each year must stay here in china.im married for more than 5 years now with my chinese husband amd want to try applying for green card.am i legible to apply?or if not then do i need count 5years again after that year i was out of china for less than 9months? pls advise..thank u so much.

The Law says you can apply if married to a Chinese national and a residence in China for at least 9 months out of each of the 5 years requirement.  It does not say you will get it if applied, do.  In fact, VERY SELDOM those are granted, and about the only sure way to get one would be to have a large cash investment in China, in the order of millions.

Only the years that you were in China over 9 months will count towards the 5 year requirement.  But you must prove that you were here by providing the "Registration Form of Temporary Residence for visitors" and/or copies of your passport entry/exit stamps.

I have a friend from UK who has been married to a local for 7 years, live in China, meets all requirements except the investment, applied for it and was denied.  The only thing he got was a two years residence permit instead of the normal one year.

Now, if your husband has the proper connections, you may be luckier than my friend.

happys right.  Its all about the investment.  If you afford to "buy" the green card, then you get it.  its not just a case of being in China for so many years.

The investment is a plus, but to be honest it's really for Asian spouses like Singapore, Koreans, and so on. I also have a friend from the UK and he got a 10 year perm. resident card," not a green card", for being married and living in China long term. But was also told he had to keep an updated passport from the UK at all times and also needed a FEC and resident visa if he intended on working. It does not intitle him to retirement, scoial beneifits, health care or anything that the Chinese would get. It would be easier to apply for the 2 year perm. visa and just renew it when the time comes.

 

There is no Green Card to China
