I am American, she is Chinese, we were married in America, but we both live in Wuhan, China. It turns out that things didn't work out and we both want a divorce. We never registered our marriage in China, but can we still get a divorce in China? What is the process get a divorce while living in China? We have no children and no property to split.

No, 100% sure you can't get divorced in China, you don't have any red marriage books to stamp, now if you are looking for a fast divorce, I have done this before and it works fine, short story divorced my Filipina ex because the Philippines doesn't have divorce, so I found Seaton Woodley a divorce lawyer in Guam, U.S, in Guam you can get divorced but you must stay on the island for 8 days at least and make sure you have a hotel bill because that is your proof that you stayed and yes your plane ticket too...
Now step one: contact him at: http://guamdivorce.net/
Next he'll send you some forms by email you and your soon to be ex wife need to go to the Guangzhou U.S embassy and take the form together and have it stamped or sealed & swearing that you both are agreeing to a divorce. MUST go together to the Embassy..
Next, send the paperwork FEDx overnight mail to Mr Woodley and he'll tell you the date and when to buy your tickets.. After all is done you will leave the island and a few weeks later he will email you copies that the judge has agreed to the divorce and than send you the real certified legally stamped & sealed copies to you by UPS or FEDx.. Than you're divorce.
Its that easy and when I got remarried in China to my now Chinese wife I used the legally stamped copy of my divorced and it was checked and it worked than I got my legal paper that allows me to marry again.
I think I paid $1200 for the whole deal. Not the plane tickets, they have Guam because many military guys need a fast divorce while working in Korea/ Japan and so on. No you don't need to be military..

Now, if you didn't send divorce papers to your filipina ex, and instead wrote a letter to Philippines authorities that you "live separately but want to give it a chance", you would be my idol. She'd be married into oblivion, while you are divorced and can get on with your life! I wish I had done that in the past...

My ex wife was with me during the divorce and registered at the Makati city Hall.. I always dot my i's and cross my t's... Oh I should tell you that the Guam court will make certified copies for both of you.. How's assumption working out for you? Not a good method.

Now for anyone needing to divorce a Filipina/Filipino and you're not from Philippines, please read article 26 of family law, There is no divorce in the Philippines, however there is one exception when divorce can be recognized in the Philippines is in cases of mixed marriages or marriages between a Filipino and a foreigner. In such cases, the foreign spouse may avail of divorce from his own country or from any other country which his own State will recognize. This is anchored on the 2nd paragraph of Article 26 of the Family Code of the Philippines which provides that “Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall have capacity to remarry under Philippine law.”

yes, but i know from experience that there is a gap between obtaining divorce papers and registering the divorce. my ex divorced before we even registered the marriage, so i ended up registering a divorce, mostly for her benefit. i WISH i had left her in legal limbo. i would remain unmarried until i married another, and she would never be able to prove we were divorced. hindsight is20/20.

mmm, maybe it is different now, we took our American divorce cert to Makati city hall and the told us to get its certified by the DFA than bring it back to the annulment office, we did that they took from us for about a week, than they handed it back with a tagalog & English paper stating the this marriage has be handled aboard thus allowing the Filipina to remarry within the Philippines.. and last but not least a simple purple stamp from the Makati city hall office.
You can't get the divorce if China if it was an American wedding. Check with the US embassy/consulate nearest to you for advice on doing it long distance back in the States

In my opinion as a typical american, the most important thing for any foreigner like us to remember is to conduct the divorce proceedings in accordance with relevant chinese law.
however you may be able to conduct this divorce in the US by proxy, i'm not sure unfortunately.
I am not certain, better advice above however... I was married in China and the marriage did carry over to Canada. There is a rule however... if you and your wife are separated for more than 2 years, then the wife can be legally divorced in China. Not sure if the same thing applies in the U.S.

Sad to say it wouldn't work in China without those red books, thus that Chinese girl could marry in China if she didn't report it to China that shehad married in the U.S. . But a marriage in the U.S must be done within the U.S, or Guam.. Divorce is a business back in the U.S.
Because you did not registered your marriage in China, you did not any legal obligation to follow the divorce procedure in China.
However, you need to follow the divorce procedure in America.
