Q: How can I get my salary from my boss?

     I recently moved to Shenzhen from Hangzhou because of a job change. I started working in February. The problem is after a couple of weeks on the job I noticed that nobody was asking me for any paperwork. And nobody was talking to me about the legalities. So I asked if the school was legal to hire foreigners? And I got a resounding "of course.We wouldn't hire you if we were not." The real worry started when I went to the police station to register my new residence. At the police station they told me that I needed to bring a Chinese friend. I was puzzled, because I only needed to inform them of my new location. Something I used to doing in Hangzhou. Anyway, they spoke to one of the managers at my job. After the police woman hanged up the phone she told me to come back with a Chinese friend. Two months later after I got tired of hearing don't worry you're okay, someone finally accompanied me to a different police station...where I got turned down, of course. They finally took me back to the first station. This was after visiting two other police stations. I got a registration voucher with my residency permit expiration instead of my lease expiration. 

   Sitting on the job for five months with different heads telling me not to worry has gotten me so stressed out, because by now I'm imagining all those people in prison in Dongnuan suffering, because they became illegal on Chinese soil, gave me the worst headache since Hangzhou. This is when they finally admitted that they cannot help me with the necessary paperwork. They said that they could help me get a tourist visa but not a Z visa. I signed a contract and everything. In the contract it stated that the company will assist me to get a Z visa and the FEC. 

     They are not legal to employ foreigners. During the signing of the contract they told me I couldn't work anywhere else. My biggest problem is I want to leave but they will not give me my salary. They have last month's salary and the days that I've worked in this month. And I'm too broke to call it quits. What to do?

legally you can't , if you have connections with the parents they might push the school to you.

Schools in China apparently don't need 'laowai hire authorization' anymore. Anybody can hire foreigners in China if SAFEA comply and issue Working permit or A,B,C certificate.

As I understand that was one of the changes at new Law. Rep. told me that change is on since 2015.

 

I am in the position of changing an employer and at Public School only Native English teacher can get WP, buTT ... rep. connected me with agency in nearby city who assured me they can get WP for Non-native English teacher.

Dial SAFEA and ask them for an advice and help!

That's a hell of a situation you're in.

 

The only thing I can think of is to tell them that because of the situation they put you in you've contacted your embassy for advice, they know who you are and the name of the school and that you really need them to pay you what they owe.

I would also drop into the conversation the fact that you're seeking advice on the ESL teacher forums and SAFEA.

 

Don't be threatening or hostile (yet), just give them a reason to worry that their school will be named and shamed online which will make finding their next teachers harder and that there is a chance they'll get unwelcome attention because the embassy and SAFEA are involved.

Oh, and in the meantime I would print copies of any emails you might have from the school saying they'll get you a proper visa.

 

It might be useful later if you need to plead your case with the PSB.

if you are still working... tell them give me my salary now, or I stop working.

Either they give it to you and you stop working then, or you stop working because they dont give it to you.

 

Lesson learned: never be so broken to not have fuck you money

Finding an employer, who'll apply for an Invitation letter; 2. Exit China and apply for Z visa in your home country's Chinese embassy; 3. Enter China in 30-days after Z visa was stamped into your travelling instrument ...As I am aware, you won't be able to switch to Working permit by remaining in China....,so make ready for a return to your home .... -- icnif77
