Q: I don't know what to do with my visa! Need help, please!!!

Hi, all

My situation is the following. I work as an English teacher at school (I'm Russian) . I'm working under Z-visa. My contract is due to finish in two months and as matter of fact the school will cancel the visa and work permit. But I want to move to another city in different province and try to find the job here. So will it be legal from my part? Do I need to go to HK to apply for another kind of visa?( f.e. F visa) Or if you know the better way out I'll be very grateful for your help!!!

You should find new School before your current Contract (Residence permit) expire, and make them extend your Residence permit.

 

Your old School should give you Release letter, and cancel your FEC. Your new School will need 'FEC cancelation certificate', when they'll apply for new FEC.

 

You will probably need new Health exam (certificate), too. Health certificate shouldn't be older than 6 months for extension of your Residence permit.

 

I am in the similar process now. You can probably expect troubles to obtain all necessary documents from your old employer. If so, contact Foreign Expert Bureau in the city you are currently in, and they will talk to your old employer. 

New School must extend your Residence permit in 30 days after expiration (cancelation) date. If your new School start extending Residence permit in 30 days after end of old Contract, there is no need for another visa, or traveling to HK.

You can apply for a travel visa where you are now.  It should get you 30 days and cost like 500 rmb.  Then you have 30 days to move around the country and find a new job.  Once you are hired by a new company in a new province you should be able to change to a residence permit.

Thank you very much for the answers!!! To find a new school in advance is really hard for me now, because I live in a very small town that's far away from the city I want to move and I can't come for an interview. But I'm very surprised and glad to know that  my old school must provide 30 days L-visa. I think this is the way out!Thanks a lot!

I don't agree with 'that's the way out'. You can find new Residence permit sponsor just by sending your CV to Schools you are interested in. When you get new School, you can make day trip, and conduct interview in person, and if School is too far away, you can conduct interview over the Skype or phone.

I wouldn't advice you to wait till the end of your present Contract.

 

Last year, I had F visa with expiration date on Aug. 22. I had contact with 3 Schools since the end of June, 2012 for new position. They all liked me, and what not. Suddenly, two Universities stopped replying to my emails. The 3rd one in Tianjin, asked me for my passport, and promised me visa extension.

FAO returned with my passport on Aug. 21, and told me Tianjin PSB require I return to EU, and apply for Z visa at Chinese Embassy in my home country. She also had ready plane ticket Tianjin - Hong Kong.

Out of 3 perspective Schools, I ended up in HK applying for job at bad placement agency, just to get Z, and return to China.

I won't wait till my Residence permit (visa) expire ever again. Chinese don't know, what is 'planning'!

I signed my present Contract with School in Xinjiang, when I was in Dalian, Liaoning, or more than 4000 km distance. We conducted interview over the phone.

I'll try to find a school(but when you're not a native then it's harder to do over the internet, that's my concern) So if i find a school and sign the contract can a new school start the process of extending while I haven't finished yet in my current school?If yes, will they need me to come?

It is difficult to know all answers ahead of time. Just start to talk with new School asap. Then you will see, what kind of requirements do they have.

I accept reasonable demands, butt...I won't travel from Dalian to Shenzhen  for interview.

If School is interested in your employment, they must be reasonable with their demands too.

Mostly, School wants to hear your English pronunciation, after they saw your photo. You must let them know, you won't travel 1000 km one way for an interview, even if they will refund ticket cost. It is unreasonable demand, and I promptly quit contact with such School.

Edit: No, School doesn't need to 'start' extending your Residence permit before permit expire. There is sufficient time to do that after expiration. Most important is, you MUST have new Residence permit sponsor before your current Contract/Rpermit ends. You will be 'in the tight spot', if you cannot find suitable visa sponsor (School) on time (30 days after the Residence permit expiration). So, I think it is better to have new visa sponsor as early as possible. You should sign new Contract as soon as possible. You can sign Contract online, and email it back to the new School. Then, after you finish your present Contract, you can travel to the new School location for Medical exam, Residence permit extension, and work.

Finding an employer, who'll apply for an Invitation letter; 2. Exit China and apply for Z visa in your home country's Chinese embassy; 3. Enter China in 30-days after Z visa was stamped into your travelling instrument ...As I am aware, you won't be able to switch to Working permit by remaining in China....,so make ready for a return to your home .... -- icnif77
