Q: If you quit your job your residente permit will be canceled?

Hello,

I am thinking quit my job for study Chinese for 6 (my resident permit time) months/look another job

 

So If I quit my job my resident permit will be canceled?

 

I can quit my job with friendly terms, this is not a problem.

Yes. The RP is tied to your job and when you leave your employer is obliged to tell the PSB, who cancel the RP.

 

You can probably convert to a student VISA ... I have a friend who did that. I don't know what was involved though.

 

Definitely try to leave on good terms, your old boss might be able to help changing your VISA.

Disclaimer: This is how I understand the law to work, but having said that I've heard of cases where people leave their job on good terms and the school didn't cancel their RP.

 

Someone will probably chime in now explaining why I'm full of shite, because TIC and rules are made to be bent.

I was on a Z/Work Permit for all of last academic year, but I only did a few hours work for them (although, I was working with them a bit more than that - but not what the contract said).

 

Also, there are those who get a work (or other) visa without employment anyway...

 

so, yeah - not going to be a problem, unless.....

RP cancelation after quitting job isn't required in every Province by my experience.

 

RP was canceled only in Fujian, and it stayed intact (after I resigned, because of employer's contract violations) in Liaoning, Hebei and Henan, so I am not really sure, if RP cancelation is warranted at quitting. 

In all examples above, I had new job lined up, and I worked in different Province with RP from another Province. At new city, we just visited PSB for updating of their records concerning my RP (different) sponsor.

Fujian rep. told me there is quota on FTs in the city, so after School cancels RP of one FT, they can employ new FT. I am not sure, if this is true.

 

If you are sure, you can quit in friendly terms, ask School's rep. what is procedure, if you resign.

 

If you want to look for another job, you should find new job, before you quit your present RP sponsor. For the new job, you will need Release letter and FEC Cancel cert. from your present employer.

It won't be a problem if your boss wants to, AND can.

 

If you get a new job, you should change the visa to reflect the new sponsor. If you don't, your old boss is still responsible for you, and as the sponsor of your visa, it would be illegal.

 

But, if your boss' company is only permitted to have 1 foreigner working for them at a time (or however many, and you're taking up a spot), they may need to cancel it so they can get someone else in.

 

It shouldn't be a problem changing over to a student visa - but it will depend on which province you're in. For some, it'll be easy, For others, a total PITA!

Sometimes yes, sometimes no. But today is different, companies are now under pressure to cancel it because of the fines that are being placed on companies that let employees just walk away and work some where else on some other companies working permit.
