Q: In need of advice: changing employers and FEC

Hi everyone,

 

I recently posted a question about the ownership of the foreign expert certificate. The school that I last worked for is refusing to give me the cancelation document of my certificate. Can anyone please let me know what can be done to obtain this document? Is going to the authorities an option?

Visit SAFEA in your city. Other name for SAFEA is Foreign Expert Bureau. If you're in the smaller city, you might need Chinese/English translator for interview at SAFEA.

It is the same office, where you got your FEC. If you don't know the address, go to the Bank, where you hold an account (or any other Bank), and ask bankers for help with address and Gov.'s location.

 

School is required to give Release letter and FEC cancelation certificate to you (or to your new employer) in 30 days after your last working day.

Because in almost every Bank in China, there is at least one person with passable English. Where else in China you could find that? In Hospice maybe, or in English Language School. Nowhere else!

if you have a RP (in on a 'Z' visa) you have nothing to fear by going to SEAFA.

do you have prove about that like a mail ?

if they don't and you did everything follow the book you can suit them.

When your read the print in the FEC, you will see the print implies the FEC is your property (similar to your visa and passport) as you are the one who must sign it.  When a school or recruiter doesn't give it to you then you should be suspicious.  The people you are working for do not have a license to hire FTs and therefore your contract is not valid. You should definitely contact SAFEA.

School is authorized to hire FTs, if FEC was issued by SAFEA.

However, School likes to keep FEC in their possession, because if FT walks away (home) with FEC, School will have problems with SAFEA, because it hasn't been canceled.

I believe, School is obliged to cancel FEC at the end of the Contract, so it's 'handy' to keep important document in their drawer.

icnif77 is right, they like to keep the FEC but reminding them the law "The Foreign Expert Certificate must remain in possession of the Foreign Expert at any time" and the penalty for breaching it (instant removal of the company's Alien Employment License + fine up to 50000 RMB) will often suffice for them to give it to you.

 

They might use excuses such "But it's for your safety" to try to keep it, just say "So you also want to keep my passport or am I big enough to take care of MY belongings?".

 

They want to keep it because if you walk away they need it to cancel it and your RP, without it (the original not a copy) they are powerless.
