Q: Overstaying at China without visa

I was given a 1day temporary entry at China but I overstayed for 33days now. I want to go home because my father died.. I don't know how. Will i be put in jail or pay for the penalty?? Please answer thanks

What's a "1 day temporary entry"? You mean the 24-hour visa free transit?

 

if you've overstayed 33 days then you're very stupid and in big trouble!

 

the fine is normally 500 RMB/day up to a maximum of 20,000 RMB (33 days = 16,500!) AND possibly 10-14 days in jail. 

 

Why the hell hell did you overstay? You're supposed to have an inward flight for the transit visas. Why didn't you use it?

You will be asked to pay a fine at the airport or the land border or the port when trying to exit the country.

 

China doesn't go after illegals, such a waste of resources, they wait for you to show up and arrest you on the spot.

 

You won't be allowed to leave until you pay the fine, you will be sent to the prison for foreigners for like 2 weeks while they sort the paperwork out.

In Shanghai,you get detention depends on officer..mine was 15days detention for overstaying for 3 years. No fine.just need to pay the 10 day visa fee they will get for you after your detention.within that days,you need to get back to your country.

You did not  'overstay" your visa.

 

You deliberately violated the Chinese immigration laws, and now want out because something has happened that has stopped you from intending to stay for much, much longer - illegally, and deliberately.

 

Actions have consequences.... this will be one of them. Deal with it.

 

And don't go crying to this community when it sucks! After all, it was YOUR CHOICE!!!

Depending on where you are, you might be able to sneak across the border to Vietnam on foot. 

 

 

Seriously though, you knowingly violated the law, so don't expect much sympathy from those of us in this community who are here legally.

I missed a date one time     years ago....  cost me my $1200 plane ticket    500rmb fine, and a lost week getting it straightened out.        think it was 3-4 days

I am sorry, but you flagrantly violated the law. I would not stay in China or any country one minute past my expiration date and you have been here 33 days (and counting)? Why? People like you make things harder for the rest of us. You need to make up a story and turn yourself in, or figure out how to smuggle yourself out of here.
