Q: Resignation Letter Misunderstood?

I posted here before, as an anon, about my situation working on an F visa in China, while the school broke the contract and provided a not-so-great living conditions and working conditions. I sent my letter of resignation in after receiving my months wages. 

The placement 'manager' I was working with wrote back pretty quickly, telling me to stay until the end of the contract and how important it was that I at least stay for the children.<<I am really sorry for these trouble which caused you unconvenient. But we can solve it as long as you can continue to teacher for the less then 3 month. Otherwise I don't how to say to the students and their parents.>>

Although I have stated that I will not be working at the school or for the company any more, they also have told me that they will find a new placement for me, in another school with another 'good' package. <<I already asked teacher X, the one in charge of the schools, to place you in Hangzhou with a good package and good apartment>>

They also said that the F visa was legal to work in schools all around China BUT Beijing (where I had originally asked to go) because they were part of a cultural exchange program with many schools. 

My letter was quite direct, and explained my personal and legal reasons for leaving. I clearly stated when my last date of employment would be,  and I also thanked them for the time I had there and for the experience I had working with the children. As a result, I'm unsure of how to respond to the company, or if I even need to. Is this just an attempt to get me to change my mind? Or has the school not got the message? I'm not sure how to deal with this situation.

If you are in China working on an 'F' visa you are illegal.

Leave asap and go to a legal job.

Do not trust your school - they could be preparing to drop you in it with the PSB for all you know and you could end up being fined and deported.

your employer does not care about you - they only care about money and the parents of the students.

If they broke the contract they can not be trusted with anything, even promising to get you a new job with another school.

an  'F' visa IS NOT LEGAL IF YOU WANT TO WORK - ANYWHERE in China

they are lying to you.

Find an new job that provides a 'Z' visa yourself

do NOT tell them where you will be going when you get it - they do NOT need to know

make sure you get any and all pay owed and LEAVE asap

 

Type 'SAFEA' in the search box above to find your nearest office to contact

 

you are not legally employed now and you could be deported, and it sounds like your employer is choosing to 'misunderstand' you - something that happens when they don't like what they hear

 

if you must respond, tell them you have a family emergency that requires your presence  at home and you have to leave immediately.

And what do you think she should do??

I'm actually not employed now because I have resigned, and informed the company I will no longer be working for them.

Contract is not valid/binding, if you're working with (wrong) F visa. Both, you and your employer are against Chinese law. You can walk out of the School tomorrow without any repercussions or (bad) records. No Resignation letter is needed either. You just need to find new employer/Z visa sponsor.

 

Since, you are in Hangzhou, you are probably working with Helen Group and Hongtao Wu.

Contact SAFEA (Foreign Expert Bureau) in Hangzhou. They helped me once to deal with Helen Group.

Enter 'Helen Group' in search above for more threads about Hangzhou and SAFEA.

 

If your Co. is offering you new job, accept it only if they will sponsor Z visa, which is only right visa to work in China.

Sorrel's answer is great. I will just add that many times in China the "bosses" are used to refuse a resignation. This is of course not legal but it is a matter of face. I've seen it in my company many times an employee will come with a resignation letter and the boss will plainly refuse it and the staff is crying because they "cannot" resign. I find it odd and part of the Chinese close-minded culture not to be able to leave a job whenever you want, many times I would take the employees apart and explain them they can leave anytime, they notified the company and they should go, either the company accepts it or not, it's call freedom.
