Q: RP extension. How many days should I have left on my RP extension when arriving at new job?

I'm switching jobs. I thought it would be a simple process but this is China and people's obstinacy and bureaucracy have foiled my plans for a smooth transition.

My RP expires on January the 31st. My contract concludes on the 24th of February. My boss expects me to work through most of the time of my RP extension and this only allows me a few days (less than a week) to get a new RP in my new city.

Any advice? I have a good working relationship with my boss but I would guess he doesn't want me to leave early.

Sort it out with boss about leaving to the new city, first. 

 

It's confusing a bit, because your Contract expires later than RP. 

My present RP and Contract expire on the same day. That was the same in Xinjiang, Fujian, Henan (twice) and now in Guizhou.

 

A week before RP expiration, you must go to PSB for new extension. Cops will keep your passport 5 working days, and if extension will be 30-days (My RP extension at the end of the Contract/switching employers was always 30-days), you must move to the new city fast.

 

Doesn't matter on desires of your boss, you should leave to the new city as soon as you get your passport back from PSB.

That will give sufficient time to the new School to apply for new FEC, and extend your RP till the end of new Contract. You must complete new ME, too.

 

At your new job, you'll need Release letter and FEC Cancel Certificate.

 

Chinese Gov. is closed down for Spring festivities, what will make your transition a bit hairy, but not impossible. Just leave to the new city as soon as you get back your passport with new extension.

Never mind length of your old Contract, RP rules!

How can I find out about my RP expiration date taking precedence over my contract conclusion date? A link would be appreciated but I don't expect you to find one. I'm talking to SAFEA this afternoon. I can't expect that my contract remains valid if they can't provide me with a work permit. Typical mix of incompetence, obstinacy and bureaucracy is making things fucking impossible. IMPOSSIBRU!

Call to SAFEA is your best bet for true info on RP extension.

Come back and write what did they say, 'cause of last week's thread/comments 'My boss make transfer difficult' and 15-days RP (exit) extension.

 

Dalian SAFEA told me in 2012:

'Your employer must give RL and FEC cancel cert. to you (or to your new employer) in 30-days, after your last working day. That is Chinese law!'

Contract and RP: 'If you are required to respect Contract (date) over RP end, your boss must take you to PSB a week, before RP expiration and get RP extension till the end of the Contract. Then, when your Contract and RP ends on the same day, your boss must take you to PSB again for 30-days RP extension.

Too much 'walking to PSB' in one month, so I say 'RP supersedes the Contract'. ---> 'logic!'

You aren't required to work till the end of the Contract, after you'll get 30-days extension. RP extension isn't dedicated to finish your Contract. Its purpose is:

- give your new employer enough time for all 'work' till new Contract RP extension ----> no China exit!

or

- travelling around China and prepare for the exit!

No work during 30-days extension, just pack&move to the new city.

If your contract expires Feb 24th, demand that they extend it to Feb 24th.You need your release  docs now to start the process, if you are changing cities you need at least 30 days, assuming everyone involved knows what they're doing.

Plan for your boss to resist at every turn because that's what Chinese do.

They: ''meiyou'! RL just before you leave the city.''

 

The whole story was like this: 'one new job asked me for RL, before the Contract show, so I asked School's rep. for it.

he: 'I'll give it to you in two days!'

me (to the new employer): 'I'll have RL by Friday!'

Then on Thursday, rep. called me and said: 'The highest boss of all bosses said, she will give you RL after you'll give an apartment back!'

New employer walked away, of course.

 

'L hand to the R pocket ----> around the arse'.

Usually what I've found is that the new school just, well.. sorts it out.

 

You tell them the situation, they talk to their contact and close friend in the local visa office and they tell you what is required, if anything.

I think this approach would be your best bet, assuming you trust their ability to get you the RP of course.

 

Something I've been told and have counted on myself in the past is that while your application is in the system being processed you can't be done for being without a visa, you're treated as if you have the RP.  Of course this may vary based on where you are, who the school knows, the mood of the official on that given day, whether or not you drank hot water this morning...

Whatever I see last two months by looking for the new position, there are not too many Native English teachers to take new positions in China. Placement agents try to sell anything (to me).

Mastards, no respect toward my 8th year documented working history in China.
