Q: Terminating my contract

I signed a three-year contract here in SJZ and now I'm regretting my decision, in my contract it says there that i can terminate my contract but i need to pay 10k for it, will there be any chance that might get ‘blacklisted’ if i end my contract without paying them?? Thank Smile

has your employer breached the terms of the contract in any way?

If yes, then you have a legitimate way to terminate without penalty - get SAFEA involved in this.

It it something that you can discuss with your employer to fix?

Are you just 'flaking' because some minor issue is not 100% to your liking?

you need to supply more information rather than just looking for a hand to hold yours to validate your position.

Sure, we all change our minds about things, but to do it because of a minor inconvenience in the work-place is hardly the actions of someone who wants to be seen as a professional - this applies to any field of work.

Doubt this is a teaching contract the OP is referring to. Far as I know the majority of teaching contracts are 1 year. 

 

Its normally non-teaching contracts that are for longer. My last factory contract was for an initial 3 years (as are most Chinese contracts to avoid iron rice bowls!) but...I could also give one months notice to quit, with no financial penalty, which I did 2 months ago. 

 

Will be be interested to he more from the OP on what the job is & why he was stupid enough to sign-up with this 10k penalty clause.

yeah my contract is open ended. Has no termination date on it at all, just a general termination clause if either I quit or am sent packing.

My basic understanding of Chinese employment law for non-teaching jobs is that normally the first contract is for 2-3 years, then renewal similar. If someone then either works for a company for 10 years of gets their contract renewed a 3rd time then it is very expensive for a company to get rid of staff. Even at the end of a 3 year contract I believe the company still has to pay the employee off. 

 

Though sating that I'm no expert & the above is just a few things I've read when checking what my rights were when looking to change jobs a few months ago.

There must be a way to terminate your contract, but your employer will very likely have to cancel your residence permit and work permit if you are legally employed.

When I see a post like this I doubt if it is true. Why not tell us the reason? Why not tell us how far into the contract you are? You give us no info on the visa ? You don't even tell us the job.

teaching contracts are not allowed beyond 1 year by chinese law, so if this is a teaching contract, go to fec office and have them politely pay a visit to your employer and explain the facts of life, especially the fec 5 year rule for teaching experts, they have the final word, not your employer.

Do you have any links for that law? My school forced me and my bf to sign 1,5 year contracts.. And we are also not very happy with it and trying to fibd the way to escape this prison with minimum loss

It's a teaching contract.. I've been staying here for more than 6 months now and i apologize for nit being specific enough with the details.. It's my first time to work abroad haha Smile
