If you're a foreigner, you must apply to the provincial court in the district where you originally received your marriage certificate.

 

You have two choices: no fault-divorce, if you are divorcing amicably or the court procedure involving lawyers.

 

Divorce usually requires a period of separation of at least one year. If you can prove that you've been separated for two years, the proceedings are much easier.

 

Do a Google search for "China marriage red book and divorce" and you'll find lots of information on the topic.
