Q: What do u think of `Chinese Student Hits and Kills American, Posts 2 Million USD Bail`

American local media are reporting that the mother of a 19-year-old Chinese international student, whose speeding in Seattle of King County in Washington state caused one death and injured four local residents, has posted the astronomical 2 million USD bail to get his son released. Prosecutors were worried that the foreign student would jump bail but nonetheless allowed the release.

 

According to a Seattle Times report, in 2012 November, Xu Yichun, a Chinese international student studying at the South Puget Sound Community College in Seattle, was driving his newly purchased Mercedes-Benz C350 with four other students on their way back to the apartment from grocery shopping. Xu Yichun did not stop at a stop sign and broadsided a car driving towards him, causing severe injuries to the other driver, 25-year-old American female Brenda Gomez-Zapata, who died of her injuries 9 days after being taken to the hospital, with the other three passengers in car being severely injured as well.

 

The police investigation found that at the time, Xu Yichun was driving his car at over 60 mph, when the residential area’s speed limit was 30 mph. Xu Yichun told police that he was driving only a little faster [than the speed limit] and it was only because his GPS navigation system showed that he had taken the wrong road that he had made a U-turn.

The police then found out that Xu Yichun does not actually hold a Washington driver’s license, nor an international driver’s license. He confessed to police that although he has a driver’s license in China, he has never driven in the United States before.

Xu was arrested and taken into custody by the police. King County prosecutors on 2012 November 14th charged him with 6 offenses, including one count of vehicular manslaughter, three counts of vehicular assaults, and two counts of reckless endangerment. On December 6th, this case will be heard for the first time at the King County Superior Court located at the regional justice center in Kent.

 

 

Recently, Xu Yichun’s mother rushed over from China and produced a 2 million USD cashier’s check at the March 1st local time bail hearing. After verification by the county jail, her son was released at 8 o’clock that night, but Xu Yichun’s Chinese passport was still held by the court.

Deputy Chief of Staff for the King County Prosecuting Attorney’s Office Ian Goodhew said, “Rarely is a bail of that amount posted.” He said prosecutors asked the court to set the bail at 2 million USD because if the bail was too low, Xu Yichun would very likely jump bail once he posts bail. He said there had been similar cases where Chinese nationals somehow fled to China after paying the bail despite having their passports seized. He said: “We are very much concerned he won’t show up for court.”

China and the United States currently do not have an extradition treaty. Goodhew said that if [Xu Yichun] jumps bail, it’ll be hard to get him back. But at the same time he also acknowledged that because Xu Yichun does not have a violent criminal record nor has he failed to appear in court before, it would be very difficult for the court to refuse bail.

This case has a lot of attention from the Seattle media, with the local population actively commenting on news websites.

It's so mind-numbingly easy to get back to China after paying bail. You don't need your passport... and this is a really sad story. It shows how so many Chinese can't stop speeding, breaking the law, etc. They think the west is like China, where they can buy their way out of anything.

I am confused, the accident happened about 18 months ago, but doesn’t say the boy has left America yet, so when is the trial date? I must admit that I have always been curious as to how someone without a license to drive a car can buy one. I guess you could buy it as a gift or an investment, but really it isn’t that hard or expensive to get a license to drive in America so why not make it a requirement of the purchase? So should I assume he also didn’t have insurance?

And it would appear that neither the offender nor his family have any remorse for the victim. They are only concerned about themselves. Why do I not find that the least bit surprising?

If you can pay $2 million dollars bail, you can pay a cargo ship captain $10,000 to smuggle your son to China.  Why not set the bail at $10 million, of $50 million? In any case bail is too low if the parents are paying cash  and not a bail bonds man and do not care if they get their money back.

According to http://newsmotion.org/tags/xu-yichun, the kids father, Xu Zhaohong "told Sing Tao Daily that he “is already back in Beijing… Everything is alright with my son. Thanks for your attention.”"

 

I haven't worked out who the 'he' is in that quote from his dad.

 

Also, FTR, the dad is Chief Executive of China's TaxChina.com... the only accounting company in the land that trains certified tax agents recognized by China Certified Tax Agents Association.

 

The car the kid was driving was a 2008 Mercedes-Benz, bought only 4 days before for him, costing $31,000 (I don't know whether that's considered a lot in the US... in Aus it's not that much).

Here are the top three ways that they get out of the country after posting bail:

 

1) Container ships.

2) Smuggling into Mexico and boarding a private or commercial jet to China.

3) 2nd copy of their passport... no, seriously. You take away their "original" passport, but you didn't take their 2nd copy. And their names aren't on a no-fly list, so they can easily leave. It's so stupid.

Seems reasonable. How much you want to bet they researched his family's net worth before deciding on $2 million, since they probably know very well he won't be back. Good job and next time milk them for more.

Actually it may be a "bit" unfair, as I knew a case where a rich little s**t I went to high school with had a long night of drinking and killed a 60-year-old man in a head-on collision on the way home. He ended up with a couple of thousand dollar fine (and probably a much larger lawyer's fee) and slap on the wrist, because he was a rich little s**t and his dad was well-connected. But over here seems like the yuan is the wang (money=king), they will have no remorse and need to be hit hard in the wallet.

Not really a china or china vs other country problem, this shit happens all the time. The main thing is that currently law only apply to poor people. The banks screw the world with financial crisis, despite they aren't killing people directly but due to it lots of people's life got ruined, people lost their job, home, saving, etc. 

 

You would have think those bastards will get a death penalty but they don't even go to jail or receive some decent punishment. Hell even now they keep screwing the poor and the government doesn't do shit.

It's called a "double standard", and some hypocritically whine about the west supposedly being "racist" in its relativel generous immigration policy. This is bad for expats in China, first, and China itself, second. You can't be a mecca for the world's talent if the don't have equal protection under the law.
