Q: What happens to a student for overstaying a visa in china?

A certain student was admitted by a university in china but he lost his tuition fee before he could arrive in school but already in china,he pleaded with the university before his visa could expire for them to give him time to look for money but was told to ask for money from friends. He tried to ask from friends but nobody had because this was the time most countries were not performing well economically. His parents told him to beg the school but the school could not understand until his visa expired while he was in the office begging for documents to extend his visa.Right now he has overstayed for almost two weeks.Any advice and help from whom it may concern? Thank you.
More details:
Initially, the guy had money in his standard chartered bank account and part of the money was sent through western union, so he had to withdraw the money from his standard chartered bank account and collect the other part from western union. He did just like that. Now he wanted to go and keep all the money in china bank account as soon as possible. Now his money was in a backpack and it was quite a busy day.According to his explanation, he was not sure how the money got out of the bag cause he found himself empty after reaching the bank.Furthermore, registration was on 7th and 8th and he did the procedure except paying the tuition fee.His friend promised to lend him half of the tuition fee on condition that he convinced the university to let both of them pay half of tuition fee,they were allowed but at the time of paying,the university changed and it was a failure. Some days passed and his visa was expiring at the end of this very month(September). He took the matter home and the response was that his sponsor told him to ask the university for half payment but the university refused, then it was at this point that he explained the problem to the university. The university delayed him as he was asked to see people from his college and lastly to talk to the dean in the morning of the last day of his visa to expire(No clue that he could visit the immigration cause he was a freshman). He was just told the dean went out for an appointment and the dean left a message that he was just to pay the all fees.This was a Friday (which was followed by a national holiday =every office worker(Chinese) gone for holiday lasting for a week).And he even went to the immigration a day after the expiration of the visa only to find offices locked.The first day after the holiday he went to theuniversity office and was only told to go to the immigration without any papers.He went there and explained, they told him to go and pay fine and then extend his visa for 10 days to pay all school fees.Since he had no money and the sponsor could not bear the fees,he was advised to go and ask for papers from the university to take to the immigration for a month extension to get out of china but the university refused.So it is very long,but I think he was told to take the matter to the embassy.

Ask him to send you a postcard. Then tell him to hand himself in. The longer the overstay the worse the penalty.

 

He will be held in prison until someone pays for his deportation flight (he can't pay for that himself) unless they give him a 5 day leave notice.

As it is still near the start of the academic year, why had your friend not got a student visa to cover the whole year, starting from the beginning of the semester?

having a 2 week expired visa half way through a semester sounds strange

 

Was the money stolen or what?

Why is this a problem in October when fees would normally be paid in September?

Did the student not contact his/her embassy for advice?

Actually,when someone enters a different country from theirs,they get a first visa in their homeland from the embassy of the country they want to enter.The same applies when you are already in a foreign country but just want to change university, you will have a visa which was issued using the previous university. Thank you for reminding me.

His visa expired while he was in the office begging the university? So his was in their office 2 weeks? Troll question.

He will not go to prison, he will have to pay a fine, the max is 5000 rmb. He will have to interview with a detective about why he overstayed. He will get a new 3 day visa to get his fee money / flight in order.

Maximum fine is 10,000rmb if there are reasonable circumstances. If the circumstances are that you knowingly overstayed, as it appears here, then a much more harsh penalty is in order. Recently, a stay in detention while your flight is paid for is becoming more routine.

 

I know someone this happened to due to overstaying for almost a month....and yes he is a moron. He thought he would get a fine on the way out. He spent almost 3 months in lockup while it was all sorted out. His embassy wasn't interested in him or his problem other than monthly checks on his welfare. He has told me that there were several other foreigners locked up with him waiting for someone to buy their airfares. Some had no hope of this occuring.

Losing thousands of Yuan down the back of the sofa, we have all been there. It is near the end of October, like Sorrel pointed out. Surely such circumstances should have been solved by now. How exactly did he lose the fees? Were they not kept in a bank account?
