Q: What would you do?

You come across some sort of criminal activity at work (be it small scale corruption, or fraud, or theft, etc).

 

What would you do about it?

 

Take my case, for example. I recently got the proof I was looking for that the Chef Financial Officer in charge for taxation at my work hasn't actually been paying the taxes for the foreign workers to the tax deptarment. What really pissed me off was that the finance was demanding I come up with fapiaos to get full reimbursements on my allowances.. or they take tax out of it as per regular income tax.

 

Bringing this issue up with line managers has done nothing... the finance officer himself is pretending I and this issue doesn't exist... and other workers are giving me the 'you're a trouble-maker' attitude....

 

So, what would you do?

 

Ignore it - it's just part of the culture.

 

Report it to police, tax dept?

 

Post on forums and publicly shame the company/employer?

 

Blackmail the guy?

 

Something else???

my opinion I would report it not to the police but to the special website the gov has setup to monitor and investigate these issues as they are cracking down on corruption and bribery as of late.

Find another job?  I don't have this problem at my company.  I get paid the full amount per my contract (no deductions, withholdings, etc), and then they take care of paying the taxes.

But, how do you know it's actually ending up in the State Administration of Taxation's hands? I got a statement indicating how much they said they paid (took from my pay), yet the tax dept had NO RECORD of ANY taxes paid by my company to my passport number... and the tax guy refused to give me my unique tax record identification number...

 

so, are you so sure they're doing the right thing?

 

As for finding another job... already ahead of you on that! :)

Nomally most reputed international companies has got guidelines given to employees on how to handle these type of cases... normally if you are not getting required response from your line manager.. there should be one man appointed to directly deal with cases like corruption (like the one you sited) .. like a safety valve.. or ombudsman... with him you can even keep your identity under cover and see actions are being taken..

 

Check your company's base governance documents and try to find out ..

 

In your particular case where you are getting statement from comapny and also contract clearly states tax paid by company.. so you dont have to worry at all..

But for the good of the company you are working.. you should report...

 

I should also admit if you are not working for a reputed company.. this might even be coming from top management... to save money.. its just too much % tax for foreigners salary level.. inf like that.. just make your side legally clear and forget about that.. its none of your business..

do you have your receipts for them claiming they paid the taxes? then it is not your problem. this is their toilet it is not our jobs to fix china. this country is ass backwards so if you report it they may close rank against you making seem like you are the guilty party, rather than have an outsider cause one of their own to lose face.

 

if you do not have your receipts demand them in a written email.

Each person reacts in a different way.  To me, you are placing emphasis on the wrong place.  You are after the Chief Financial Officer, and your emphasis should be (as Crimo well said) on insuring you are not hit with a tax bill in the future.

 

So, if I were in your shoes, I would:

1.- Stop immediately talking about the problem at work or with anyone from your company anywhere.

2.- Gather all pay slips that will show how much you have been deducted for income taxes, and with them and other pertinent documentation, do visit the tax office.  There, as a reason for your visit, explain that you may be changing companies in the near future and before doing so you wish to make sure you owe no taxes.  Do not say one thing about the company or financial officer.  If they can not find any records of you paying taxes, show your pay slips and demand an immediate investigation without accusing anyone of anything.  Let that come out of the investigation, and you will not get blamed for the blow up.  And do not tell anyone what you have done.

3.- Start looking for another job very soon.

I wouldnt complain to strongly. Your new and dont need your colleagues to resent you so quickly.

Why not request a work station change? Next to an open window? Put a fan behind you. Keep the smoke at bay. It depends at your city but in larger cities its becoming much more acceptable to request a smoke free environment.

I would tell them I'm asthmatic, and can't be in the same office with smokers.

 

I would ask for different office on my first day, even if I'm not asthmatic.

If no smoke free office granted, I'll poison everybody with Montecristos. Let's everybody enjoy (heavy) smoke then!

 

I get pissed at passengers in the train, and I show them 'no smoking' sign. If they don't stop, I complain to conductor. I didn't get free train ticket, therefore I have rights!

Yeah, tell them straight up you have asthma. You need an office change or you can die. I bet you will get changed quick enough. 

 

Otherwise, since Summer is coming up put a fan on your desk like Mike suggested and then have a plan ready when Fall comes. But honestly, you have rights and one of those is to not work in a smoke infested hole.

I haven't done/seen it before, but I've definitely heard stories about such things. I was told that it's better that you don't risk yourself to help people, especially in public places, only to end up in a planned scam.

 

I guess each case is different. In China though, there are organized activities that solicit help and assistance publicly for money, so being hesitated to help is only natural when it comes a situation like this. Don't blame yourself too much, I'm glad the old lady is ok! Smile

If your phone has a camera on it, film it from the point she is struggling on the ground to when you pick her up.If a friend is there ask them to film it. if she tries to say you pushed her or whatever you might be able to show the police the video as proof.

The thing i find about teaching is that it is great when everything goes right and you can concentrate on classes, which is why you are there.

It sucks when this is undermined by the background **** like you seem to be experiencing.

Check your contract to see exactly how your conditions of employment have changed/been breached and make sure they have no grounds to withhold any documents you need to change schools.

You don't need the energy you need to teach children - and they need a LOT of energy, sucked from you before you go into the classroom.

there are better employers who will let you concentrate on what you are there for which is teaching, and are not so petty and money minded that they can't recognise an asset then they have it.

Move on!

 

Look at your Contract about Resignation notice. Try to respect Contract, and as soon as you find new School, give them RNotice.

You must receive Release letter and FEC cancel certificate from present employer, so your new School can extend your Residence permit.

You can quit your Contract immediately, if your present employer doesn't respect it. 

Post new Q, if you have problems with quiting your present school.

If any troubles with 2 docs., contact SAFEA (Foreign Expert Bureau) in your city.

Are you still in the probationary period? Every new contract has at least a 1 month PP. My advice, use the escape clause to pay the fine and leave (30 days notice). Do everything you can to get the ref. letter before you finish because after you leave he might give you a negative ref.

If you are in SZ there are countless opportunities, avoid training centers and you should be able to find a good place, say bye to the kids with hugs, bye to your coworkers (because it's not their fault I guess) and explain to the parents why you are quitting without naming anyone specifically but "the administration" or "the management", then walk away.

 

Some parents might even pull their kids out of the kindergarten if you are quitting, it happened to me before. The kids and the parents absolutely loved me and some parents even transferred their kids from other classes to my class. But there the administration was crap and tried to trick me countless times (holding salary for no valid reason and other BS), when I decided to quit (I have my own RP) a number of parents pulled their kids outside the kindergarten saying that if I am not their teacher then they don't want their kids to study there and a few of them ended up in my new workplace (same city, much better school).

 

Of course the administration panicked when they saw that a large number of kids were leaving with me. They tried at first to threaten to cancel my visa but I reminded them that they didn't get it for me and that it is not tied to the school, they didn't even have a copy of it, that they are powerless. Then they offered me more money but I said that money wasn't the problem, they were the problem.

 

When I happen to meet other foreigners who are working at this same school, they all complain about the administration, 2 years after I quit, seems that things didn't really change over there.
