Q: Looking for a way out

Hello,

 

I am working in Shenzhen and I was not paid my full salary but half. Just a few days before I asked how to get out the contract. So now that I was paid half I want to follow up on the breach. The company told me the school reported I worked half the month.I don't care about the money but I would like to leave the company. Where can I go with my contract ? They told me even if the school fixes the mistake they can't pay me the other half of the salary till next month because taxes will be too high. I called the FAO they told me they don't deal with these things.

Your contract should have a clause in it relation to what happens in the event of a contract breach.  

it should also have a clause regarding quiting.

 

Talk to whoever is directly responsible for you.

The most important issue is: 'your signature and date', or in other words 'whatever you signed, you must oblige'!angel

No one here can offer you advice without reading the contract. You really should be careful what you sign.

Might be best to use email to communicate to your employer rather than verbally. Then you will at least have a record.

Be polite in your emails, but ask them questions. Can they explain the tax rules, can they give you a record of tax payments. Address of the tax website and so on.

Just try insist they answer by email... just be really busy and have no time to stop to talk.

Did you only work half a month? I mean if you are working in public schools, lots of them did only have classes for half a month. These are things you really should ask during the interview.

Take it for granted, Chinese won't help you, you can't seek Chinese help, simply they will question you about your problem, after they take their time to understand and that's all what they want, then they will tell you sorry we can't help you.

Butt.....before you A with another lie:
If you have Z/RP no school in China can pay you only 1/2 pay. School is required to post salaries for your work (or Medical) monthly, i.e.' you work 30 days, and then you get salary 15 days or so later'.

How can it happened, School would pay you only for 6 months of work?

Whoa, an ESL school in breach of their contract... well that is something new!

 

Playing nice never works. You need to threaten them with calling the embassy, PSB, SAFEA or whatever... if they don't care... it is cause they have guanxi.

 

So if they do have guanxi, you need to embarrass them. And threaten to tell all the students and parents... or something generally cost them more money than they would by just paying you off.

 

At this point, they will become very vengeful and if nothing works by now... you may want to consider just taking off and learning your lesson. Seen this happen more times than I can count...
