Q: Anyone's a victim of medical malpractice here in China?

I used to know someone who basicly mixed drugs and OD'd (he had it coming, the idiot) and puked while lying on his back, so it all went into his lungs. They rushed him to a hospital, where he spent a few weeks in a coma, and the doctors told the parents there wasn't anything to be done but hope and pray. The parents then decided to move him to a hospital in Hong Kong, where the doctors asked them "why on earth did you wait so long?", cleaned his lungs, healed him, and after a while he was lucky to have survived.
Even after being in a coma and close to death, within one week after coming out the hospital, that guy was already taking drugs again, so I'm not sure who's to blame...
I am not even sure that there are medical practice laws on the books here in China. It's an interesting though -- firstly, does medical malpratice exist? Yes, of course, as it is exists everywhere else in the world and secondly, what are the legal remedies for it? And that's the answer that I don't know.
