Q: apply for invintation letter for a new Z (still legally working in China)

My resident permit can only be extended until august 15th which is the end of the contract.  I know the police station will hold your passport for 3 weeks while switching your resident permit to a new company.  I would like to avoid being stuck inside of China during my summer vacation and would like to simply pick up a new Z visa in Hong Kong right before the next school year starts.

My advice would be ask your company to start renewing your visa on the last week of JUNE, yes they can do that for you. There's a lot of leg work for getting you another z visa. Yes, yes, yes it can be done of course, but asking them to start renewing your visa in JUNE will work fine, and you have a point and a good reason to request this.

BTW, I think that 3 week deal is over. Last year in Shenzhen took only 7 days.

If you'll complete Contract and change an employer, PSB (Exit Entry police) must grant you 30-days L or 30-days RP extension, few days before your current RP expire.

 

30-days grant is mandatory by Chinese law. Your present employer must take you to PSB a week or few days before RP expiration. Cops will keep your passport 3-5 working days, when you'll receive your book with 30-days RP extension. Then, hurry up to the new employer's site/city.

 

Your new employer has 30-days to get your new Foreign Expert Certificate, after you will hand them Release letter and FEC Cancel Certificate, and with new signed Contract, your new boss will be able to extend your RP for the duration of the new Contract.

 

There's no need for China exit and new Z application, which is PIA for everybody involved. Especially (new-2014) Z visa application form.

Your new employer can't apply for Invitation letter while you're still under valid Contract, because they must present new signed Contract, which cannot be dated before your old Contract and RP expire.

 

 

If you plan vacation during Summer recess, exit China after new RP is granted.

It's either - fix it before you leave, or create a real PITA for the school and do it afterwards...

 

But, you can NOT leave the country without your passport, and HK can NOT issue you a new RP, nor extend an old one - they can only issue you a Z (or other) visa.

 

If it's for a current employer, it's SIGNIFICANTLY easier to get an extension than to have a new RP for a new employer. You should still need to have a medical check done (do it NOW! It's valid for at least 6 months)

Well MY resident permit will be renewed till August 15th.  That means I must be back in China before August 15th to transfer the resident permit to a new company or at least extend it 30 days, once they get a new FEC.  This is the situation I am trying to avoid as I don't want my passport held during summer holidays.  Contract ends August 15th so I would image a new school could start my contract on August 16th and have no problem getting an invitation letter for a Z Visa? I find a more easy o pick up a Z visa in hong kong with invitation letter then to have passport in police station 3 weeks like the last time I did this during the summer holiday.  

 

Will the grant a new invitation letter that alows Z after resident permit expires on August 15th.  Lets say thet apply for invitation letter in June and invitation letter can be good after August 15th for new Z visa.

Firstly - as you already know, you MUST have your passport in your hand to enter or leave a country (including Hong Kong).

 

Secondly, getting an extension for a current employer is MUCH easier than getting a new visa for a new school issued! A - it's MUCH quicker, and B - much more likely to be granted.

 

Thirdly, if you're thinking about getting your 30-day tourist visa extension, as is issued to all RPs for the purposes of leaving or finding a new job.. then you need to realise that they will ONLY give you this wihin about a WEEK of expiry. That is, if you go in now to request it, they'll tell you to go away and come back (much) later.

 

You are correct - if your current RP expires on 15th of August, if you're back in the country before then, then there won't be any real problems.

 

Remember - the PSB does not care what you want! They will NOT give you 'special snowflake status' to accomodate your wishes. So, be prepared to NOT have things work out how YOU want them!

Something doesn't add up with what you want to do. 

 

You don't want to be back in China before August 15th to renew your work permit / resident permit. Okay we get that. So where are you planning to be? Back in your home country? So why would you want to get your Z-visa in Hong Kong when you could apply in your home country?

 

Do you know it is not automatic to get a Z-visa issued in Hong Kong anymore?

 

As stated sbove. They don't keep your passport 3 weeks anymore. They've improved again and it's more like 5-7 days.

Well Hong Kong is best as I am living in Shenzhen and will return to this area at the end of the summer to get my things.  I understand as long as they will print hong kong as your pick up location for Z visa on your inventation letter then you can pick up your z VIsa in hong kong. Also I know it can also be done in 24hours rush fee.

You're right on both points but it's IF they will do invitation letter for HK pickup. 

 

One other thing to consider. Some areas now require degree authentication. I'd suggest you check on this as well.
