I am not happy at my position, it is a very short contract but I don't want to stay. Not sure what the best route would be and what the consequences are. I know my contract says I need to pay 6,000 cny for one year but I am not contracted that long. Is it best to receive a letter, does it even matter once this visa runs out?

you say you have a very short contract, but not how short.
maybe you should just stick it out
if your employer has breached the contract in any way, that is an out.

4 month contract. I have 2 months to go, my contract is very vague says if they are not satisfied for any reason they can terminate me without compensation. Had other plans that fell through so now that I am halfway there and they are showing signs of being unsatisfied I would rather cut my loses and leave. I don't want to work in china but don't want to burn bridges.
1. Get your release letter.
2. Get a copy of your canceled FEC.
3. Ask will you cancel the RP after I leave.(I think no).
4. Find a new job now that can hire foreigners.
5. Leave and resign according to your contract and do it in a professional manner..
So, you want to leave cos you're not happy???
That's it? Not bad conditions? Not lack of pay on time? Not being violated on a daily basis? Just "not happy"???
FFS, just deal with it like an adult! See out the contract, then go back to whatever kindergarten you're still enrolled in!

I diagree Shining, why spend time in a job that you're unhappy at if you can afford not to do it, or have another opportunity. You think two months is nothing to be at a shitty job, I think it's two months you can be doing something you actually enjoy.
Shining_brow:
OP signed a contract.
Does that mean nothing, Brother?
Personally, if I signed a contract - especially for a short time, and my employers had gone out of their way to make things happen for that job (ie, visa crap), then I would feel obligated to see out to the end of that contract (unless I'm being done a number on!)
This post was brought to you by the words 'responsibility' and 'commitment'.

The best way would be amicably - of course. When that is not possible, you may want to take a look at this... http://eslwatch.info/china-2/about-the-law-china/12172-cftu-china-law-update-how-to-legally-break-your-china-foreign-teacher-contract-without-penalty-loss-of-visa-nor-pay.html
Ask Vickie, she has no trouble breaking contracts.

I might breaking my contract tomorrow.lol.I am still working on how to tell my boss after I confirmed with anothet company. But the place I am working have free coffee, tea and located in one of the best locations of Shanghai.Kind of feeling sad to quit actually. But the business goes shitty at the beginning.Guess better to leave now. PS:He has to be careful since he is a foreigner unless he doesn't want to stay here now.I do not know much about foreigner. But it is easy for me to break the contract.I can quit one month earier due to the labour law or piss my employer off for getting fired.lolThese are two safe ways to break contract as local Chinese. I really hate being paid every next month for monthly salary.
I came based on lies, the school says I am too strict and reduced my pay. I am in the sticks and came thinking I would get my flight when I landed but they are holding it now to keep me to stay. Then the contract was changed, I feel they are shady and don't think I will come out very well and I don' t gain anything by staying.
Victoria1987:
This school is so tricky. You have the contract, may be you can report them to the government if they had written your original salary on the contract. In this way you.may get your old salary back and leave.Or told the school you have the old contract with salary stated at hand to make them allow you to quit.Ask a local good Chinese friend for help you there if you can, some Chinese employer will dara not go that far in front of local ppl.One direct can quit is if the employer breakscthe contract himself, but you have to collect the proofs for showing to the government.
Shining_brow:
They don't (or shouldn't) have legal grounds for reducing your pay for being 'too strict' (which, from where I've worked, meant giving homework, and actually checking they've done it!)
Air-fare reimbursement is usually given at the end of the contract - so people don't come, get paid, then do a runner!
If they give you a new (different) contract to sign - don't sign it! Simple!!
Always remember - they need you far more than you need them!
get all the documentation you can outlining breach of your original contract.
communicate with your school through email outlining the problems, so there is a record of issues.
Ask your boss, by email as well as verbally, for the address of your local SAEFA office
if your original contract stated that you would get your flights paid for, then you are entitled to the money. If not, then chalk this one up to experience.
Before you sign a contact, make sure everything is outlined clearly in English. Verbal promises made here are more often not kept.
Thanks my recruiter says I am banned if I don't finish my contract is this true?
sorrel:
has your employer breached your original contract?
have you breached the contract?
it sounds like your recruiter is trying to bluff you.
if you follow the steps i outline above and also read Ironman, you have nothing to fear.
do you have a trusted Chinese friend who can help you translate?

Not if the contract is illegal. I suggest you take a copy to a law firm that specializes i labor lawy and let them give you some feedback.
If you work with Z visa/Residence permit contact SAFEA (Foreign Expert Bureau)! It is the same office, where you got your Foreign Expert Certificate.
You can walk out of School, and keep your RP.
Find new employer, authorized to hire FTs at first.
Then, resign from present School. Try to respect Resignation notice from the Contract, unless School's violations don't require immediate resignation.
Inform SAFEA in your city. You can get SAFEA's address by typing SAFEA in search bar here.
SAFEA will help you with retrieval of all necessary documents and last salary from the present School.
Good luck!
