Q: Can a 30-day stay permit be converted back to a residence permit?

I'm in Suzhou city.

Previous employer will not give the documents I need to change to a new school until I cancel my residence permit. Long story. Bad relationship.

SAFEA and foreign expert bureau's general response to everything: "yes, they must give you these documents, but there is no real deadline. We can demand they do X, but we can'talk force them. The only way to force is through an arbitration ruling.

If the RP is canceled, I must get a 30-day residence permit if I want to remain in China.

New school is ready to hire me immediately.

Can this stay permit be changed back to an RP after gething the new foreign expert certificate?

In typical China style:
1) new employer's HR initially said no problem converting a stay permit back to an RP. A few weeks later they said they spoke to the "government" and were told I would have to exit and get a new Z if my current RP were to be canceled.
2) the local foreign expert bureau has repeatedly told me I can apply for new work permit while on a stay permit, and that to their knowledge, the PSB/immigration/whoever should be willing to convert stay permit back to RP.
3) today my friend called the exit-entry administration bureau at 6660-1111 and was told I can convert a stay permit back to an RP if I find a new job within 30 days.

Yes, 30-days RP extension (or 30-days L in some Provinces) can be changed to RP.

 

30-days RP extension is issued to give new employer time to apply for new FEC, Medical exam and finally RP 'new Contract' extension. Other purpose of 30-days extension is time for FT to prepare for exit/returning home.

If you're changing employer in the same Province, PSB won't do any changes into your passport, but they will change their records of your new employer, what happened to me in Liaoning. I continued to work at different employer with same RP.

If SAFEA suggested Court arbitration, your thing might be hairy.

I had demands of school in Fujian to cancel my RP in 7-days, and after I dialed FEB, they told me what are School's demands, and after I complied with SAFEA's suggestion, school gave me RL and FEC Cancel Cert.

This two documents you'll need to extend/change your 30-days extension to RP with new employer. By Chinese law, School is required to give both documents in 30-days after your last working day.

If FT violates the Contract, 30-days RP extension isn't warranted. If violation is grave, PSB will cancel RP and make you exit China in 7 days.

In your last question from 3 weeks ago, you said you had been sacked and were in all sorts of legal wrangles with your ex-employer.

Changing jobs between companies licensed to employ foreigners is pretty straight forward.

I think your best bet would be to drop all your complaints about your previous employer, shake hands, get your release letter and move on. Put all your issues with your previous employer behind and move on.

Release letter obtained. Before giving rec letter and FEC cancelation letter, they're insisting on canceling RP, claiming they're afraid I'll sue them (whatever that means). I offered to sign a letter saying I won't sue. They still insist.

That might be new requirement in China for 'mandatory RP cancelation', as it happened to me in Fujian (2014), and it didn't happened in Liaoning (2012), when I moved to Xinjiang, and continued working with old RP.

 

I suggest you dial SAFEA, and inquire about/let them know about conditions. They'll make sure, you'll receive both documents.

Hello

 

I am in same situation with DISNEY ENGLISH they are issuing me a 30 day stay visa (humanitarian) they call it, ive been trying all over websites to find out if I can get my residence permit from it, seems that my prayers have been answered above. So the "stay visa" is like a 30 day extensiion onto my RP then? My school in Gounagzhou have been trying to contact PSB about this issue to find if I can get RP from it. Seems the answerr is "yes" then?

SAFEA (Foreign Expert Bureau) is the place to look for the info about it. It's the same office, where you got your FEC. 

You can also contact Provincial SAFEA. Type 'SAFEA' in search above for the address and contact no. in your Province.

I got L visa from hong kong can i change it to Z visa if i m already enyer in china

You can't get Z in China. You must exit China, most likely to your home country or HK (if you're lucky!), and apply for Z at Chinese Embassy.

 

1. Sign Contract with employer, which must be authorised to hire foreigners;

2. Employer will apply for your Working permit and Invitation letter at SAFEA (Foreign Expert Bureau). It will take around 30 days or less to get both documents. If you want to apply for Z in HK, Z pick-up city must be written on Invitation letter, which must be approved by SAFEA;

3. Both documents must be mailed in original (not emailed) to your home (or HK) address;

4. You'll present both documents in original at Chinese Embassy with Z application form, which must be completed online. Pen corrections on Z application form aren't permitted. You'll need 1 or 2 photos.

5. Z visa stamp in few days, and arrival/return to China.

You'll might need Non-criminal Certificate, what depend on your country of origin. If USA, you're required to present Non-crim Cert. I believe Non-criminal Cert. requirement depends also in which Province you apply for documents. In Henan, I (EU passport) had to present it last year.
