If you leave before the termination of your contract, can the employer cancell your working permit and visa?
9 years 17 weeks ago in Visa & Legalities - China
1. Z expire in 30-days after your entry, so 'no'.
2. RPermit can be canceled, but you must be present with your passport at PSB. Cops will grant you 30-days L or 30-days RP extension. Purpose of 30-days visa is 'traveling', either to your new job site or exiting China.
BuTT....'big dog' is SAFEA, not PSB.
After you finish your Contract or resign, because of the employer's Contract violations, school must issue Release letter and FEC Cancel Cert., both docs. needed at RP extension and issuing new FEC.
Employer must give you (or to your new employer) both documents in 30 days, after your last working day. ------> Chinese law.
If you don't have both documents, and you just do a 'midnight run', prepare yourself for exit, before the expiration of RP. Your new employer won't be able to change records at PSB of your new working city, what makes you 'illegal'.
At 'midnight run', you can also expect troubles, when new employer will apply for new WP and Invitation letter, both docs. needed at (new) Z application.
It's safer, if you believe both SAFEA and PSB hold records on foreigners working in China.
The employer can cancel your FEC (blue book). But if you're saying you want to cancel it and go around china until the end of your REsidence Permit, then you can. Release letter and FEC cancel cert is needed for in-country employer change. But if you midnight run, and leave at the end of your RP. You wouldn't need those 2 documents, because to apply for a new SAFEA working permit and invite letter you just need the same documents as always.
