Q: Can an employer terminate an employee without any prior notice?

Can an employer terminate an employee without any prior notice?

I worked for my memory dolls almost half year. They dealing on wedding cake topper. .

Total 3 of girls worked for them in China. We all worked for them from home as they are USA company and have no office in China. We contact though company Email box and skpye and QQ. We help them contact with the artisan in China and follow clients orders.

Half month ago they fired one of the girl and all the pending works passed to other girl and me.

They told us we just need work 2-3 hours per day base on that salary, but in fact we need to work 4-5 hours per day and sometimes even more than 5 hours.

Me and other girl really think works are too much so we suggested they hire more staff to share the works. The CEO A** is not happy and after the meeting he sent email and saying will hire more staff to share the works.

After he hired new staff, we trained them few days. And at the day when the new staff start to share the works, me and other gril found The CEO A**  frozen our Email box ,and delete my skype and QQ contact.

And one of the artisan in China told us they got notice from the MMD that we were not belong to their company.

So my colleague msg other manager about what is going on and asking for salary/compensation pay  but no answer.

So I Email them and informed them we will suit against them.

And then they replied quick: You ladies are welcome to try and "prosecute" all you want, but as long as we pay you for your time, we have violated no laws.  And then they transfer 14days salary to us at night.

We Email them and asked the reason why we got fired and why they have right to fired staffs without notice & delete staffs online contact, they never reply us.

And after 2 days. they Email us a termination letter and list some reason why we got fire. But none of one we think is true. So we ask them give us some explain and prove it. But they also not reply anything.

It is super inhuman and ill-legal. Anybody have same situation before?

They dont have an office in China.  They dont take care of your visa. You do not have legal employment in China with that company. They can fire you whenever they like. If they really want to , any company can  fire you at any time citing breach of protocols in contract. Its a grey area and hard to accuse without sounding like a sore loser.  You should consider yourselves lucky that they sent you money.

You are screwed.

Working under the radar will make it easy for your boss to fire you with no comebacks.

Short answer, yes, they can. I've known it to happen before to several people. It doesn't really matter what the contracts say so long as the companies have the right connections and grease the right palms.

You're the worker, and their the boss (If you're the Westerner and they're the Chinese, that's another strike against you, but Chinese workers can be exploited easily enough), so they are right and you are wrong if you try to fight it.

Seems to me you are Chinese working for an American company ( a shady American Company) . Chinese companies do this all the time, but clearly you are blind to this. They paid you all the money owed to you, but you have a problem with that? Many of my students who are now working, worked for companies that simply stopped paying them (typical of Chinese companies). And they have absolutely no recourse . According to you, (difficult to fully understand) they gave you 14 day severance, they paid you for 14 days and told you not to work, ?!?!?!?! What more do you expect?

Exactly what law did you think they broke?

Can somebody explain to me why Chinese bend over and take it when it comes to Chinese media, govt, companies and employers but when it comes to a foreign company movie/film or business/product they demand treatment far and above what is fair and legal?

They paid you for 14 days to not work and you have a problem with that. I know teachers (Chinese) that have not been paid their salaries for over 2 years.

God the more I read crap like this, the more I am disgusted by the lack of intelligence and logical thought.
