You could try and if you have a valid argument I'm sure you would win. However on the basis of equality here it probably won't be a good idea. Remember if the judge rules in favor of the other person or dismisses the case you won't ever get a fair trial again. If you don't want to sue them just threaten them and I've found that many foreigners got their back pay that way. Good Luck!

I haven't heard about this issue but you have to be very careful and be still in your decision if you will pursue it. Make sure that your evidence won't be against you in return. You can inquire the department of labor and employment in your area.

Of course you can but the process is vastly different from, for example, United States courts. BTW make sure you have a suitable bribe, no, gift for the judge. That's in addition to lawyer fees and the gift does not assure a win. 

 

It's a complicated mess. Perhaps you should wait until they actually adopt something resembling a western court system.

I like to be in China, but I expect shit and cheating from my employer. Just one of the things you have to accept if you want to live here for awhile.
