Sign up with Google Sign up with FacebookQ: Can I apply for a new visa in Hong Kong if I overstayed?
I have overstayed my visa for 40 days...that was a stupid mistake. Now I have paid the penalty and the PSB issued me an exit visa, I need to leave this country in 10 days.
I have been thinking to apply for a new Q2 visa in Hong Kong, but I have been reading information like if you have a " * " on your exit visa, it is very likely the application will be rejected.
Does it mean I will have to go back to Australia to make the application?
Thanks to anyone who answers my question.

Did I say that already once?
You won't get reply of poster here 'yeah, I overstayed once and I got new visa without problems ...'
Chinese use computers, too! Your overstay is recorded and visible to anybody at every Chinese Embassy abroad.
Common sense is 'you will be denied at new Chinese visa application anywhere you go ...', but 'Good luck'!
Change of passport is one way to avoid bad record surface, however I don't understand how since your name stays the same.

What earlier they just look at the passport's no. and disregard the name of the holder ...? Stipud from Admin side ...
I'm curious what the monetary fine was?
and
what excuse did u drop for overstay?
I can't read? Numbers are different in my country? I was on a bender? Or the Time-Honoured Classic..... I forgot.
I believe if they mark your passport you'll be banned from any China visa for 3 to 5 years. Better try to get a new passport if the number changes like Americans do, than apply in Australia is safer.
Thanks guys, @diverdude1, the fine was 10000 yuan, they did not put me in detention.
I went to the PSB with a girl from our HR department, she explained that it was because someone who handled my residence permit was no longer employed, and the rest of them were not aware it was overdue.
I don't see any stamp on my passport says overstay, the only thing I am concerned is the exit visa, I will be back to Australia next week and I will let you know how things go.
diverdude1:
10k? ouch. ¥250 a day. That's harsh. I think I'd tell them I'm broke. Rather have the jail time...
You didn't read your residence permit? Well...
You could possibly write a letter to the Chinese Embassy in Canberra, with a note from your school, and explain your circumstances hoping they'll let you back in... That probably won't work though.
Sorry to say it but you fucked up. China won't be having you back in a hurry (3-5 years etc).
Sometimes your only purpose in life is to serve as an example to others.
you can't really convincingly blame someone else if it gives you the expiry date in your passport. that will just annoy them if you make that or any other excuses.
i don't mean to be the harbinger of doom, but i think you almost certainly be rejected for a new visa. most countries take overstaying a visa very seriously and it is an absolute inflexible rule
i heard that changing your passport number by getting a new passport may help. although you think that would be nonsense.
Yes...I believe my situation is not good , I will explain that was my mistake and hopefully they will show some mercy.
@diverdude1 a friend told me that the detention will be considered as crime, I am glad they only gave me an administrative penalty ....
You did not say what visa you were here on. If you were on a tourist visa or business visa.... forget it. A student visa or work visa.... they might listen to you... in OZ.
On a relevant side note, i recently came to my attention that they are aware of you previous passports even if the number has changed. A new name may help but the psb was aware of my previous passport even though the number was different and the details it contains. I assume they check name, date of birth and place of birth details. Perhaps during the due dilligence process they can ask your embassy if you are the same person. Who knows? But they know.

I had problems at the Bank ... to get info/access to BOC account, I opened in different Province.
I ID myself with new passport ... and after several hours, I was asked: 'Do you have two passports (you terrorista ... )?'
me: 'No, I only have one passport.'
She: 'BuTT ... you opened account with different passport ...!'
me: 'No, I didn't ... ohh, wait ...'
I had my old book with corners clipped by the Embassy in my bag, so all was well in the end, but yeah they aren't going by the name, but by the number.
That might be 'cause is so many of them. Everything is limited except-o the numbers ... and sex/pregnant women.

Update: I have received a new working visa at Sydney visa centre, since my work permit was still valid. Documents I submitted for the visa application included visa application form, work permit card and a letter say I will not overstay again.
Thank you all for your suggetions, I am happy it worked out!

Thanks for the update, it's always good to hear what happens to the OP in these situations.
Glad it worked out well for you.

Great! Nice of you that you sent us an update!
Letter about promise 'you won't overstay again ...' is also new info to the Board!'
HK is nice for the short stay, but in real it would be a waste of money and time to try with new visa in HK.
