Q: Can I stay in China after my Foreign Expert Certificate is Cancelled?

I left my old job six months ago to take some time off, travel round the country etc. However,  I have now found a new job and need to apply for the Z visa. My old company didn't cancel my permit when I left, but said they would help me do it now. If they go to the PSB and say I left in April, will I then be subject to fines because I didn't leave China? 

 

Any advice would be greatly appreciated.

FEC cancelation is at FEB (SAFEA), not PSB.

 

Your new School needs FEC cancelation cert. to get new FEC. 

 

No fines, if you stayed in China on valid Residence permit.

Technically yes, a Z visa expires 30 days after you enter China, and your RP then takes over and works as your visa.  But since RP is issued based on "work", if you leave workplace you have 10 days to change employers, or leave China.

That said, reality may be different.  It would depend on where you are located, and the mood of the officer dealing with you at PSB.

My experience as long as RP remains valid you should be ok.  But as happyexpat writes all depends on location an mood.  laws are grey.

Even though your FEC is canceled, you are allow to stay on as a tourist  (can't work) if your residence permit is still valid. ONLY if your residence permit has expired, you are leave before it does or be considered an illegal. 

 

But while your residence permit is still valid and you have found a new employer, they can easily get you a new FEC online and you don't need to leave the country. It's the medical that you have to do if the last one done was over 6 months ago.

 

But both your FEC (canceled) and residence permit had expired, you need to get the hell out !! Should leave before your residence permit expired. Simple as that.

I taught my first year in China. After I finished I changed my visa to a tourist visa, which let me stay in China. My school hadn't canceled my FEC at that time, so as long as you have a valid visa then the FEC is of no consequence for staying in China. However in order to get a new work visa, your school needs to cancel the FEC.

Is your RP still valid?

I mean the dates... from... to

By my sums, you had a one yeat RP, so worked for 6 months, left your job then travelled.

It could be difficult to say you were still working when travelling because every hotel you stayed in checked you in on your RP. You have a paper trail.

Might be best to be honest.... just in case.
