Q: Can you apply for and get approved for I-130, Petition for Alien Relative while living in China ?

I'm an American citizen living in China and I would like to start the process to get my wife to be able to move back to America with me.  It look slike the I-30 (pettition for alien relative) is the form I need to complete.

 

My situation though is I don't plan on leaving China for a couple of years.  Is it possilbe to fill out this form while still living in China and for her to get approved while we are both still living in China.  This way eventually someday when we do decide to move back to America everything is already complete.

 

I'm a bit worried there will be some sort of requirements where I need to be in America already for a certain period of time or that once she is approved we will need to move to America within a certain amount of time.

 

Any information would be helpful.  Thanks!

the office to do this is in guangzhou, not sure of the number there but they should be able to help you.

The answer is yes its possible to go ahead and apply and get the permanent residence card for her.  You can do that while both living here.  Once she is approved she will have to visit the U.S. within a certain time period (I forgot what it is but it is fairly short, probably a few months) at which time she becomes an official permanent residence and the official card will arrive in the mail there. 

 

The problem with that is you said you still want to live in China a few more years.  Living outside the states on a permanent residence card is possible but it can cause trouble.  Once inside the states, she should apply for a re entry permit if she wants to stay outside the states more than 1 year or less than 2.  It takes some time (typically 30-60 days) to wait on that and do the appointment which MUST be done inside the states.  Without that you might not be able to keep the green card.

no no no when you apply and get approved she will get a temp green card for 2 years in which time she has to stay in the us then you apply for a peminet green card which is good for 10 years then you can come and go as you please once you get the perminet green card you can apply for us citizenship good luck
