Q: Didn't Pay Taxes

So as it turns out, after a year of working at this job, my boss finally tells me she doesn't have to pay tax.

For months I asked her if she was paying taxes on my behalf and the answer was always, "you don't need to worry about it".
I kept all of her messages and proof of the 14000 in total that she has taken from me (Signed payment stubs, excel sheets, bank statements, etc.) and of course all of the bullshit reasons she came up with besides taxes why she was taking the money.
So my question is, will i get in trouble now that I know I wasn't paying any taxes this past year working here?
I just canceled my FEC and am waiting for the cancelation receipt to take to Beijing for my transfer, so I don't know if I will run into any trouble for asking the bureau now.
Should I ask the bureau about this?
I plan on filing arbitration...my guess is wait on that.

most chinese don't pay taxes and everyone cheats, if you go to flushing, new york city chinatown, the restaurants dont take credit cards or debit cards, cash only because it leaves a paper trail at the bank for sales tax, corporate tax, etc.

 

some restaurants in china will give a gift instead if you dont ask for a receipt when you pay cash.

 

new zealand sends tax examiners to chinese restaurants after counting customer traffic all day to see receipts match sales because the chinese cheat on revenue sales tax there, this happens all over the world by chinese people, they are cheating and stingy to the extreme, they make jews seem like robin hood.

 

Most foreigners will leave this country and never know the taxes they supposedly paid never got to the government and never will. I remember a well known chain school would not provide proof of taxes for an insurance claim for medical problems of a foreign teacher and paid the hospital bill themselves in cash instead. the agencies that you talk to about the taxes are a different government agency than the taxes, government agencies in china dont cooperate, hell, they are probably still using xp software from the last century, like the so called top 4 banks in china still do.

Your employer is required to pay taxes on your income, as I understand. Employee can't be held liable for not paying income tax. 

 

Dial FEB and ask them about it. I don't think, employer can skip paying your income taxes once FEC is issued.

 

I'd say, there's nothing to worry from your side, since you have receipts of tax deductions. Only thing you should worry is 'were you overcharged for the tax payments' i.e. funds deducted from your pay are higher than required tax amount per your salary.

There's web link of required income tax somewhere. I read about that a month or so here. See that for the required tax amount on your pay.  

I don't have any tax receipts, just tax-deducted salary amount posted to BOC every month.

How do you know, employer didn't pay income taxes?

She told me outright she doesn't need to pay them and neither do I the other day after months of evading my questions.

So basically all the money she took was for her own personal reasons.

Very strange! She admitted act against the Chinese law. In my view, you cannot pay taxes in China by yourself, if you receive salary from employer. So, I'd say it isn't your responsibility for not paying tax like it is in West.

 

Wait till transfer to the new Co. is completed (get RL and FEC cancel cert.) and then seek an advice from FEB.

On the other side, you won't gain anything, if you'll report Chinese employer for not paying taxes on your income, so why even bother?

I wasn't planning to, but I was planning on filing arbitration maybe if it was worth it.
She took 14000 from me in a year for a salary of only 13k a month.
That doesn't add up at all.

many schools dont pay taxes, if you push this, you get blacklisted and gone, and life will go on as usual with no changes to the system, crusaders in china are trampled, never to be heard from again.

Why would OP get blacklisted? It is School's violation of Contract and Chinese law, so FEB could be helpful.

 

More interesting to me is 'how OP knows tax wasn't paid?'. I can't tell for one salary in last 7 years, I am sure tax was really paid.

Deducted 'yes', but was it tax disposed to tax dept.', I can't really say.

I would keep it quiet. It is up to you but chances are she has some guanxi and blowing it up won't end well. Either her and her contact will gang up on you and get you kicked out of China or... she will get in hot water and blame you and do everything she can to get you in trouble as well with outrageous lies or other method. 

 

Up to you but just consider that they do go all out if things go badly.

You've got a couple of ways to deal with this, depending on your next moves.

 

Firstly, you can go to the local tax office (State Administration for Taxation), and 'enquire' as to the amount of tax paid. You will require a unique number (in Australia, we call this a Tax File Number). You can also give them your passport number and other info. They will then tell you that no taxes have been paid... but will say they need the number just to make sure. It's highly unlikely your boss will ever give you this number....

 

Until.......

 

Option 2 - go to the boss, and tell her that you need an official receipt from the tax department, because your home country's tax department NEEDS official documentation to say that the money has been paid. She will BS you, and probably insist that it's ok for you to just accept a letter that she types up... in which case, you now have evidence (if you want it) for fraud, which you can show the tax department. If you just say 'no, not good enough for my country's tax department", then she'll get very unhappy, pay those taxes within the next week or so, and get you those fapiaos....

 

If the boss doesn't budge, then tell her you'll go to the tax office yourself... this will REALLY piss her off!

 

FTR - if you have earned over about 4800RMB in any month, then income tax applies. They are legally (HA!) required to be paid within 15 days of you getting paid.

Something to remember is.. if you go to the tax office and say you paid but your boss didn't hand it over they probably wont accept that as an excuse. You might end up paying twice.

I would be chasing your boss and asking for receipts but not in a confrontational way, say something like your embassy said you need them for your own tax return back home or something and when you called safea to ask how to get the receipts they said ask your employer.

It's obvious your boss decided to try to steal the money but if he or she thinks safea and your embassy are on the case it might force some honesty.They wont want any attention being paid to them, believe me.

Whatever happens, you will want to change jobs after this contract ends.
