I have had to leave China on a midnite run(long story). I know i broke the contract and a breach penalty will need to be paid , more than likely to the Foreign Experts Affairs and the school. I don't mind this but if the school won't give you a release letter is it still possible to work at another school. I have heard many different answers. some say its impossible others say the school has to give you one but the recommendation doesn't have to be good. don't care. I have many letters of recommendation from other school I have worked at in china.
Can anyone please provide me with a more definate answer?

By law, the company has to give you a release letter when you leave the company. It doesn't matter how you leave the company (quit, fired, midnight run, etc...). Once you have paid all fines, returned all equipment, etc... then they must give you the letter by law.
The release letter is tied to your visa. If you get new employment someplace else without the letter, than you are technically working illegally. That is the legal side of it.
If your new employer has pull with local officials, they can either pressure your former employer to give you the letter, or just have a new visa issued for you under their company name.
Now... Depending on the reasons for your midnight run, you may have lots of other issues to deal with that may interfere with your getting a new visa. But that is another matter all together.

You don't need that to work at another place....as far as I know they never asked for that documentation. They may ask why you left your last job and that's the extent of it. shouldn't be a problem for you to work somewhere else it happens all the time and remember this is china and you know how they love to save money or rather take in all the money. If they hire illegal workers people without a degree why in the world would they care about documentation they work around those things if there company can bring in the dough on your behalf.

I could not believe that someone, for the sake of two points more, will give such a wrong answer. Coming from a person who claims to have been all the 18 years of his ;life in New England, what does he really knows about day to day life in China. But I guess we are all well aware of his continuous lies, and bla, bla bla for answers that means absolutely nothing or shows no sense what so ever.

XPat John is totally correct. Your work visa, and later your FEC, work permit and residence permit, are all tied to your original place of employment. If for whatever reason you stop working there, and seek a new job, BY LAW your former employer MUST give you a RELEASE LETTER. In fact, if they refuse to do so, contact PSB and they will intervene in your behalf to get it.
And when you do get it, you will need to apply at PSB for a change of employer and your new work and residence permits, which you should do within 10 days of the change.
And now days, with the 100 day crackdown on illegals, it has become very important to follow the laws and regulations to the letter.

Since requiring the release letter several schools are now using this as kind of leverage over teachers wishing to leave the schools.Its so sad that China is like this,even if you work hard for 2 years as I did.Once you decide to leave,give notice etc they will turn on you,make it as difficult as possible for you and then try to pull strings to ensure your time working in China is more difficult.I have been hear 5 years now and I know numerous teachers that have had this experience.Such a sad state of affairs in this country...But this is society here now and power,money and corruption are breading this at as rapid pace.Be careful.
But it could be worse,at least the world knows the real China now!
