Q: Do you think I am exploited????????

Hi again!!!。I am working in these kind of training schools. Sometimes I feel really tired. I just have one day off per week, I should work 25 hours per week but I am also forced to recite books for the kids, doing office hours like preparing classes a couples of days every week, etc. I would like to ask if you have the same feeling.

If your contract says 25 hours, and you work more without compensation, then you are exploited.

Even with 'overtime compensation', it is against Contract to assign more hours, if FT didn't agree for it. I've never seen Contract with clause 'School can assign more working hours if there is demand for it'. One can say (had said) at SAFEA: 'I want to quit!' SAFEA: 'What is the reason for termination? 'Too many working hours. I am too tired!'

according to the contract is legal. I just want to ask if you work as much as i work or for you working in training schools is more relaxed

By the way, according to the contract if i want to breach it and leave the job I should compensate the school with 3000 dollars. do you think that it is legal?.

School can assign as many hours per week/month as it is stated in the Contract. If School assign 'overtime' without your agreement, you can walk away from the School with RP intact. School is in Contract breach.

 

If you signed Contract with US$ 3000 fine for early Contract termination, US$ 3000 fine is legal. Same as anything written in the Contract bearing your signature. 'Signature' means, you agree to the Contract. There is Q about 'fine enforcing', but I would expect School will probably hold your last salary, or more.  

 

If you're not working with right visa (Z), Residence permit and FEC, Contract is not valid (enforceable).

  If you're tasks fall within the description in your contract, then no. But I understand how you feel, i've been in the same situation and felt violated. And not in a good way.

it is not possible to impose a "fine" on an employee when leaving a contract early. The legal termination period is one month. If it states anything in your contract that is different, then that part of the contract is not valid. The law is above the contract.

Preparing for classes is part of being a teacher. 25 hours is high, but if that's the contract you signed, so be it.  Are you a new teacher? If so, just take it as a general rule that for every 2 hour in a classroom, you'll need to spend 45 minutes or so doing stuff outside the classroom (marking, preparing, dealing with student/parent/admin issues) and this time should be built into your contract, either in paid prep time or in a high hourly rate. 25 hours teaching is a full-time job in my book, if you're actually putting the effort into a class required of a real teacher.

 

The 'reciting books for kids' thing, though. That's a different matter. What the hell is that about? Any face time should count towards your contact hours, not be something they can endlessly dump on you.

One comment to an answer above, and further to my comment. 25 × 60minute teaching hours (many class 'hours' are actually shorter) does not equal a 25 hour total work week. There's planning, prep, meetings, material development, workshops, student issues, marking and usually some admin to do/deal with. And that's before you start on any 'cultural differences' and the stress they can cause. 

 

 

 

Believe me, it's perfectly possible to be knackered at the end of a '5 hour' work day. I've done the 8-6 office thing and teaching is frequently much harder.

Reciting books is when kids arrive in the school they have some words in front you. Last month, the school reduced me the salary 200 yuans for not doing this job.

the best thing is always to think 25 teaching hours mean 25 lesson

you end up with 38 lessons a week and dont get overtime payment

 

25h is shitload of work if you do it real (preparing for lessons) even if you dont prepare you are the whole day (5 days) in the classroom

but still better than sitting in the office

Is this your first job?  Usually most jobs will require you to put in some extra time.  You know all those movies you see people staying late in their offices?  -- That really happens!  *sarcastic gasp!*

You need to also consider there are probably other staff (local Chinese) at your school who probably put in even more extra hours than you at substantially less pay.
