Q: Does Divorce exist in China? And what are the procedures

Always see the Chinese people in pair like doves just wondering if they 

ever have divorce and what the procedure would be.

The divorce rate in China is about 20-30% depending on which source you look at.  The US by comparisson is around 30%.

 

The procedures are fairly simple if you don't have kids and the terms are uncontested.  Fill out a form, bring it to the proper bureau and you are done.  

 

If the terms are contested, then just like most everywhere, it can get messy.  Up until a few years ago the rules were heavily in the favor of the women, but now it has shifted.  For example, it is not a given anymore that the family property will go to the woman.  It depends on which member actually paid for the property.

 

Also, the rates for alimony & child support here are pretty low.  All-in-all, divorce is financially good for the man, but can be hard on the woman.

Can one be given a divorce if the other party does not want one? Is there "no fault" divorce in China?

"Does divorce exist in China?" Of course it does. In fact, as I've read the divorce rate is increasingly MUCH higher than it used to be! Much higher than the 20-30% mentioned.

* What's strange is how the Chinese that divorce have to often have their parents intervene in the divorce proceedings/consultations/discussions due to their immaturity and pride. The parents hash everything out and the husband and wife don't even show up! It doesn't surprise me.

also, there are many many people in china who are not together but are married.

my wife has 3 cousins, all of which are married and none of which live with their husbands or wives any more.

It is all blamed on the other party to which I agree, however inside I know that is almost certainly not true.

 

If your getting a divorce, negotiate with your partner before things get really messy, give in to some requests and stand your ground with others, take into account your income and his/hers and try and be fair and civil about it.

If i were to divorce I would pay my wife 5,000 a month for the duration of time that i am in china (this would mean she would have the time to find a good job and not worry about financial obligations until I left china.

however we also have a child so things would get messy there.

Latest stat's released indicate that 1.2 million marry each year, whilst divorce has been on the rise in the past two years, from 1.2 to 1.3 million. I can understand why, they make it all too easy and rapid. Personally I think most get married because the parents liked the boy or girl or introduced them. Very often they step into marriage without really knowing each other, or each other ways, likes, dislikes or habits. Beijing government bum's on seat's surmise that the majority divorce within 3 years. Quotes from China Daily of course.
