Q: Expired visa stamp

My wife and I are in GZ on tourist visas and the 90 day stamp expired on Friday, Aug, 12. We were planning on going to Hong Kong on Thursday but I got sick on Wednesday and am hospitalized. I should get out in the next couple days but we haven't got a straight answer from anyone as what we should do about our visas.

My wife went to the Entry/Exit place here in GZ and they told her we need completely new visas even though the ones we have are 1 year, multiple entry tourist. I'm sure if she had asked someone else they would have told her differently.

What I'd like to know is, what would happen if we just went to Hong Kong, stayed there for a few days, and tried to re-enter China? We have proof from the hospital that I am hospitalized and could not leave the country, but would re-entry be a problem?

Any first hand experience would be great!

You are kind of screwed, your wife should have gone to the PSB exit entry with your passport or at least someone should have gone on your behalf... You may also be denied new Visa's, they have no sense of humor nor do they care about your circumstances... Good luck and let everyone here know how it turns out for you!

First, you should prepare to pay the penalty fee when you exit, it is 500 RMB per day up-to 5,000 RMB maximum. The sooner you exit the less you pay. Second, you may ask at (Luohu) border check or at the HK office of PRC's Ministry of foreign affairs, the authority acting as PRC's "embassy" in HK whether they think your one-year tourist visa is still fine. You can at least get a new tourist visa at the office if you have all travel documents prepared including photos for visa application. Try your best but expect the worst, the border officials usually will not show much sympathy unless you have Guangxi.

I just overstayed my welcome in the PRC, and my visa was 5 days overdue when I finally left.

The policewoman, who was quite the hottie, kindly let me off this once as a goodwill gesture, but said that usually it's a 500RMB per day fine.

It all depends on who you encounter on the border. If you look really sorry for yourself, they may just take pity and let you off, especially if you were in hospital (take the hospital receipts and medical records to prove it)
