Q: Extending RP without changing employer

My current Residence Permit expires late December  and the Uni. I work for is in the process of preparing the required documents to extend it for another year. I read online that I am supposed to apply a month before expiration but I am worried that my documents will not be ready until early December.  A person from the Uni. assured me that in the past they they successfully converted a person's RP from an old employer to the Uni. when that person had only a few days left on the previous RP. Should I be worried? What if I go to the PSB in December  to apply for an extension? The Uni. is the biggest in town and should have good relations with the PSB.

Your employer will probably try and leave doing this till the last moment possible. (laziness on their part), and they will probably tell you that there is nothing to worry about.

be aware that while your RP is being extended you can not travel (for at least two weeks), as you will not have your passport.

if you want to travel prior to you current RP being extended or expired, tell your employer that you will need your passport at that time, so for convenience the process should be commenced sooner.

as you work in a Uni, the holidays will begin just as your visa expires: you don't want to be stuck waiting for the extended RP before you go on holiday

write and suggest that this is taken care of asap, so the inconvenience of being without your passport is at a time you won't really need it

if necessary invent a compelling reason why you need to travel at the end of December.

Thank you for the reply. I am not concerned about travel as I would not be traveling until February most likely and will definitely have my passport back then. I am just concerned about getting renewed. I might be a little paranoid seeing as the Uni. wants me back and they employ dozens if not hundreds of foreigners. But I'm a worrier by nature and want to make sure I don't have to leave the country over some bureaucratic mistake.

There is no harm in keeping this in mind as you are doing, as it does happen quite often a FT comes on this site having being (allegedly) caught out on this.

Ultimately you are responsible for ensuring that your visa is in order. so leaving it to the last minute could be risky.

And remember, you also might want to travel to celebrate the New Year.

I suggest you think about your future travel plans for both the New Year and Spring Festival now - you don't want to leave these to the last minute as certainly Spring Festival is the busiest travel period in the whole year.

You should have a fair idea when classes and exams are all finished for this semester, i'd ask for confirmation from your Uni, again citing a 'family matter' that requires that you know asap when you can travel.

If you are a worrier, especially about these things, press your Uni for some definite dates, there is no harm getting these things sorted.

One month or 3 weeks prior to your current RP validation you will hand to your employer passport, photos and temporary form of residence issued by the police.

 

They will handle all other things, that is, if your employer is normal company/school, not some scam artist.

 

You don't have to do anything alone at the PSB.

 

As for the traveling, you were given again misinformation. You can freely (in the country). You have to show copy of passport to buy the ticket and PSB will issue confirmation paper (pink slip) that your visa is in process of extension. 

 

For that pink slip you might have to ask school/company to give it to you, since not all always do.

 

If all goes well, your RP will be extended within 1-3 weeks, depending on the city, school/company and their guanxi and luck. By no means should it take any longer than 3 weeks.

I think if they were able to get you the original RP renewing it should be just a formality, especially if they have good relations with the visa people, which I would expect they would given their position.

 

It's natural to stress at renewal time but as the biggest uni in town I doubt they have many problems renewing a teacher they want to keep.

I'm 99% sure you're right, but visa time is stressful indeed. Yes, they want me back (just signed new contract) and they say they are getting the foreign affairs office to prepare the necessary papers. Should be okay I think.

From my recent experience renewal of work permit/FEC is 1 week, then RP is 3 weeks directly after.

Keep in mind that there are big variations in enforcement of rules and regulations from one PSB to the next.  But, on 2 occasions, I have submitted my passport for RP renewal the day before or the day of expiration, both due to needing to travel immediately before the expiration date.  Only on the second occasion did they mention that I should have started this process a month in advance of the expiration date.  But then they processed the renewal as per usual.  So long as all your supporting documents/paperwork are in order (especially having your Foreign Expert's License renewed in advance), then the university is probably right and you won't have any issues.

It does take 21 working days to renew your RP, but you will be given a form to use as your passport for that time.  It will not allow you to travel outside of China, but domestically it will be OK.

Technically, the day your RP expires, you either leave China or become an ilegal foreigner.  This is why you are asked to file renewal at least one month in advance.  Jut be sure you renew your FEC ahead of time, and everthing will be OK
