Q: Foreign Expert Certificate

My Foreign Expert Certificate has been extended five times consecutively (totally 5 years), and the Foreign Expert Bureau refused to extend it again. They said, according to the regulation, a foreign expert (teacher) should leave China for at least one year after 5 years of work. I cannot find any reference to this regulation though I know some people whose schools wasn't able to have them employed for over 5 years. These guys simply found a new job and transferred successfully. Does anyone know about this law? What should I do? Maybe it's just my employer making up a good excuse to not extend with me?

We've already check this last month, it's your employer, you can always go down and ask the FEC office yourself.. China will not enforce this law without good reason.

Also in the mean time, I would request your release letter and have them get ready to cancel your current FEC and get a recommendation letter with a stamp on it. And start finding a new job fast, if you can't find a new job in 30 days, go to the PSB they'll extend it for another 30 days.

Tell your school you have the right to protect your career and stay in China, and don't hint you're going to ask the FEC yourself about the 5 year gig, that might piss off your school and thus not getting your release letter which is key to transferring your job, just play along for now. Don't lose your cool at this stage. You can blacklist them later if your theory is correct.

I think your right, they need a reason to let you go but also need to save face.  I have had my FEC done 4 times over the past 4 years. Each time it is a brand new one from a different school.  Have you been at the same school for 5 years? I have also found that many of the schools out side the 1st tier cities don't know the legalities either. They go by what recruiters (looking for profit) or heresay.

Yes he must have been with the same school 5 years now..Otherwise like you said you'll he given a new FEC (the red book)

He's just a fool who's playing mind game's or his employer just used this as a method to cut his five years of salary increases back down to entry level salary.
