Q: Hello to all. Visa Question

I currently hold a F visa through agent. Had to take this because someone at the at uni screwed up but I have been offered a business opportunity to be one of four  share holders in a new "school" not a training school. There will be two partners on the official paper work, one will be my brother in-law (Chinese) my wife holds Aussie passport. Told this would be easier to get the license. ( Family help from one of the other partners ). Private agreement between the four of us. My part would be to take care of the English side of things including teaching some classes. Did hold hold a Z visa but age caught up with me, I am 62.

 

My question, what should I put on the application as position held at the school or say I am doing work for them and what type of visa should I apply for.  Good advise would be appreciate.

Is the School registered to have foreign teachers? or foreign advisers?     You can guess where I am going with this.    I think you may want to talk to a Lawyer before you get to deep.  best of luck and hope it works out best regards

Thanks for the comment and concern but no one is doing any thing until my visa problem is solved. For them no me no school. I trust my brother in-law both him and my sister in-law have help out of tight spots before so all is good with them. It is in the business plan to get a license to hire foreigners. As I said my visa is the most important thing to get first.

I think this sounds very shady. As Phil said, talk to a lawyer.

 

China Law Blog offers good advice to foreigners setting up businesses in China. You can send Dan Harris an email through their site.

the problem is the business needs to be able to hire foreigners (you) so you need the business first to get a visa for you     sorry if this does not  makes sense to you maybe somebody else could explain it better than me.

No need to explain better.

 

Need to create business to then provide license and tax receipts to apply for the permission that enables you to employ foreigners in that business.

 one company, the cooperate with school and they can provide Student Visa.

I'll make it simple for you, you won't be able to renew your F visa anymore after September or whenever your F visa ends.

 

So you MUST get your Z visa or go home.

As a shareholder of the new venture and not technically an employee, the question of whether the new school is registered to hire foreigners does not apply in your situation. However, I fear that there is insufficient capital in this project for issuance of a 'Z' visa unless you are the named legal representative on the business licence. Please note that a business legal representative as stated in Chinese business law does not relate to a lawyer or somebody with specific legal knowledge. It is a person nominated within the company to hold certain responsibilities such as signing legal documents and managing the company stamps. I would suggest that the Chinese partners will not be happy for you to hold this responsibility as it would diminish the hold that they would have. It sounds like you are entering into a very complex and risky situation. You certainly should discuss this beforehand with a competent and trustworthy advisor or lawyer.
