Q: How to cancel FEC?

Hi,

 

I worked last term for a school in Guangzhou and my employer at that time got me my FEC and RP renewed until Feb 2015.

I hated the school, the apartment, the staff so I decided to quit and the headmaster gave me my release letter and he said he would cancel my FEC later.

I got myself another job (which I love) also in Guangzhou and my new school called my previous headmaster because she wanted him to cancel the FEC  and apply for a new one for me, basically he told her to piss off and he will never do it.

 

I was told, previous employers, whether or not you finish your contract, are under the obligation to cancel your FEC.

My question is: what is the way to make him cancel the bloody thing since he gave me my release letter?

Type 'SAFEA' in search above for contact no. and address in your city.

 

As I know, your previous employer must give you (or your new school) Release letter and FEC cancel certificate in 30 days after your last working day (Chinese law), if you didn't violate the Contract. You should quit your old job with Resignation notice, and not 'walk out'. 

You can 'walk out' only, if your employer violate the Contract.

 

Call SAFEA for advice and help.

Make sure you have proof that you quit within the guidelines of the contract. Send them an email, message requesting that they cancel the FEC. Request that they respond by email or text message. They will try to call you or want to talk to you in person, don't. A call to SAFEA should make them do it. But remember they legally have 30 days, so they are well within their right to wait until  day29.

Deal with your former school  yourself, Chinese people do not work within the law and that might hurt you more.

If School wants to be PIArse, they'll wait till 29 day, like my School in Dalian.

 

That won't stop new School to apply for new FEC. They can submit documents later, but 'call SAFEA ASAP', IMO.

Thanks for all your answers, I should have added  not only didn't I violate the contract but he did which means that my contract said clearly, kitchen, telephone and material provided by the school and I had none of that. On top of that he took out 1000 yuan from my last salary.

I'm gonna call SAFEA on Monday, I think they're closed on WE.

SAFEA or Foreign Expert Bureau (FEB). This is Contract violation, and you can submit Resignation notice with immediate resignation. Present one copy of RN to SAFEA, and ask them for an advice.

I didn't give them notice since they wanted me to leave during the summer and I also wanted to (I told them in July and the school term started in September), so at the end of July they signed my release letter.

I mean, as I said previously they violated the contract 4 times, doesn't that count? I have proof, I took photos of the apartment.

Contact SAFEA (FEB) for advice and guidance.

 

SAFEA is Chinese Government org., which will help you. As I understand, there's no need to pay any fee, unless your contract state such a fee.

 

Reply to the Board with update, after you contacted SAFEA.

Now after reading your follow ups this sounds very odd.If the school wanted to screw you they would have done it on the Release  letter. They can get severely punished if they do not cancel the FEC.

My contract didn't mention anything.

The thing is: why does everyone make such a big deal about release letter if that's not worth anything?????

Release letter and FEC cancel cert. are needed, when your new employer wants to apply for new FEC and extend your RPermit.

If you don't have them, you must exit China and apply for new Z visa. For some (me), that's a big deal!

Ok, that's not what I was told.

Even when employer violated contract? I was also told by a Chinese lawyer that former employers where under obligation to cancel FEC, whether or not you finish the contract once they gave you release letter.

where did you see that I hired a Chinese lawyer, I happened to meet one and even them I don't trust. Considering the responses and the piss you give everyone I didn't expect to get a straight answer from you anyway, it's like everyone on this blog like to see others been screwed!

140 was the highest I achieved on English IQ test, which isn't my native language.

 

I didn't terminate Contract over 50 Rmb transfer fee! I refused to pay it, because it was School's fault, I must move to another apartment. It's called 'principle'.

School served me with 'dismissal notice without cause' next day. I lived in their apartment nearly 45 days for free as per Contract. School sponsored Z visa in HK, and I'm gone with their Release letter and FEC cancel cert. to another School with similar paying Contract.

I'm sorry for my faulty English writings, that wasn't understandable to 2nd poster already.

Are you still convinced, I lost? Why do they call you 'troll' at eChina Board?

Hi,

 

For those who need a new FEC without cancelation of your previous school, you need a release letter and a recommendation letter from them, when you got these docs + your last FEC, you need to go to the SAFEA or send it to them by email and  your new school can apply for a new FEC for you in GZ.

Mine got through no worries yesterday!
