Q: How to get my son back to my country?

I am French, my wife is Chinese. Last year we had a son, born in China. Now I want to take him back to France, but once again, it's not easy.

My wife is from an ethnic minority. My son was born in Wenchuan, in Sichuan Province.

Of course, my son has a French passport.

 

Now what do I need?

 

I went to the PSB where I live (Shijiazhuang, I think the worst city in China), they were so happy when I told them that my wife's hukou wasn't from Shijiazhuang, and told me to contact the Sichuan PSB. When I asked them what I needed anyway, they wouldn't tell me, and announce that for each province, it's not the same.

I called the one's in Chengdu, who told me to contact the one's from my wife's hometown.

Tried to call them, the phone number doesn't work, or they never answer it.

My in-laws went many time, each time they don't get all the information, and the policemen there are far from helpful, clever or polite,

 

Does anybody know what documents I need to get my son home, and what do I need to abtain them?

I am not sure who could help you with that particular matter, but I am thinking you should try and get info about it at Foreign Expert Bureau instead PSB.

 

I asked Dalian PSB, if they can help me to get Cancelation letter of FECert. from Dalian School, and they directed me to my Embassy for help. PSB is useless! I don't think, they even understand that is Chinese internal matter, and my Embassy cannot help me.

 

Then, I dialed FEB in Dalian, and officer promptly assured me, School is obliged by Chinese Law to give all necessary documents to my new sponsor (School).

 

I am guessing, you would get right info at FEB, but I am not sure if that will happened. You should give a call to the closest FEB (Hebei). Often, you need Chinese person to talk to the FEB.

Can you clarify some things.  You said your son has a French passport.  Does he also have Chinese citizenship?  If you don't care about his Chinese citizenship just simply take him to France on his passport.  If however, you wish for him to keep his Chinese citizenship then you will need to obtain  entry/exit permit from the PSB that allows him to travel outside the country.  Below is a link I found about it. It is for Shenzhen but at least you have some idea about it.

As we have same situation recently :

 Your wife, best if all of you together, go to her hometown, to local family planing centre and police station, and get the paper stated, that your son is living there since he born. Can be use her parents address.

Than take this paper,  Your passport, visa , your wife's hukou, her's ID card, every single document you can find, take with you to the provincial, exit/entry bureau and ask for  "EXIT CARD" for your son. It should take 2 weeks and 20 rmb, but we already wait more than 1 month ... 

Anyway, need go to Sichuan, and there have to ask clearly what all need, can be different. no calls work always also for us, 1 of 20 calls they pick up and 1 of 5 answered calls are useful...  Make a 1 week trip and try your best. Good luck

i'm not sure what you are asking.  you said you have a french passport for your baby? so what else do you need?

Are you moving home for good,if yes then you can just get the exit visa only given once which Nessquick has said.But if it's a family holiday,and your coming back to China,you need to get your son a Chinese Passport first,then apply for Shengen visa.You can't leave on his French passport as it will have no entry/exit visa.

When we will go back to china , he have to get L visa, and after arrival, have to apply for same Z viza as I have . this I have been told on many places. Chinese passport will be terrible for him in future.

If you bring your son back on l visa then leave,it will be ok,but if you try to extend it or change it,they will refuse as you have to show your childs birth certificate,which will say born in China,and they  will say he doesn't need visa as he was born in China so he his Chinese..Then you have to get Chinese Passport as first time exit visa ,is a one off deal.

is it possible for someone to have dual citizenship in china? if he has a french passport doesnt that mean you can just leave as you wish??

I'm fairly (95+%) sure that China doesn't allow for dual citizenship... otherwise, SO many people would do it (mostly the locals)

My wife is from the autonomous region of Aba. This is a disaster to get anything done.

The laws are not the same. M wife called them and they said they cannot do exit permits.

We need to get a Chinese passport. Which is also nearly impossible to do. Last time, to get my wife's passport, I had to buy a contract from a traveling agency. This time they want me to send an invitation letter from France, knowing that I live and work in China.

After many calls, they agreed that a letter from my parents is enough. Still, they want to see the envelope.

This is bullshit, but no matter what this is what I've got to deal with.

I would still try and call FEB. They will advise you, because you are foreigner. 

 

I received prompt reply from Dalian FEB yesterday about my case. I called them two days ago about my matter.

Have they said why your son needs a Chinese passport if he already has a French Passport?

If your son has a French passport, then he has proof that he is a French National. Wouldn't the French Embassy be willing to help one of its' citizens come home? Or the consulate? I know it may be a dumb question since embassies and consulates here seem more willing to "make nice" with the host country and less willing to help their citizens here, but it may be worth a try.

Its very easy, just bring your wife,kid and u together, apply for the visa.  if china immigration ask u where are u going just say, we are going to visit Paris and we will ""back soon" and now china can allow your kid leave china

We got it , finally. You have to ask this, as for your sons first leave of china, even he is not chinese citizen, he is treated as he is until he leave for first time . Your wife should know how to ask it.
