Q: How hard is it to register a business with a Chinese partner

(1) Want  to open a school with Chinese partner

 

(2) How hard is this to register a business together?

You will need a lawyer. Do that straight away.

 

In 2010, you could get a six month visa if you were opening a business, but you had to register the business name first, and show you had at least 100,000 yuan in liquid assets. Mine was also educational.

 

Not sure with the new visa rules, because operating a business within China no longer interests me.

3. after you finish the license and inject the capital money of your company you can change your visa from L/F to resident visa

if you register with a Chinese partner, it's much easier than doing it yourself!

If you register a company with a Chinese partner, you can own 49 % and he will own 51 %, so he will be the boss for all legal and practical matters.......  Do I need to say more ?

It would be easier and faster to register with a Chinese partner, less requirements, maybe less bribes needed, and you will get faster responses. Why?. I do not know, but it is a fact. Doing a WOFC (wholy own foreign corporation) may take you at least 6 months from day one to having all documents to operater legally. I have done it.

As far as the visa required, to me it will be a work visa either way you do it.

Not in the field of education, but I have set up my own WFOE and helped two other companies do the same. My WFOE took three weeks from application to holding the business licence. The other companies I have helped did so in less than four weeks. Usually, the government will allow one or two years to come up with the registered capital but almost always demand that at least 20% of the capital is registered within three months of company registration. If it were to take six months to complete the process, fulfilling this obligation would be impossible as the business licence, company stamps and a few other documents are necessary to open the registered capital bank account. Without the bank account, it is impossible to transfer the capital.

In my experience with two foreign own companies registered in the field of education by two close friends, in Guangxi, one an English only teaching school (took about 5 months to get business license) and the second a grammar, middle and high school with all subjects taught in English (took almost 8 months to get business license and permit to hire foreigners to teach).

Chinese or No Chinese , if this person you think will be an aset to your job, do it with him. if you do it just to cut time , .......... to have a good Partner is a bless but also if you have a bad partner ,
