Q: HR has not produced a release letter

My HR has not given me a release letter even though I will start a new job in one week

Did you resign correctly according to your contract? If you did then you can go to the Labor Department, one phone call from them should take care of it. Otherwise if you resigned  and you screwed them over then they don't have to give you a release letter.

Your new employer will need Release letter and FEC Cancelation Certificate to extend your Residence permit.

 

If everything was OK with resignation, your employer must submit both documents in 30-days, after your last working day.

 

You can seek an advice and help of Foreign Expert Bureau (SAFEA) in your city/Province.

 

Ask your HR for address and phone no. of SAFEA.  

If you won't see any changes in HR's behavior, enter 'safea' in search above for address and contact no. of FEB in your Province. Dial them for help.

Have you actually resigned/ In writing?

 

Has it been more than 30 days?\

 

Have you gone in to try and collect it?

 

If it's yes to all the above, then next time you go in, and they don't have it, you ring the Labour Dept or SAFEA while you stand in their office, and you very clearly name the people there - such as the Head of the Foreign Affairs department.

I can't read characters yet so when I eventually handed this over to my new waiban I was shocked to learn that the contents were less than favourable. I have now contacted the DoE. Waiting to hear. Thanks for the info

You didn't actually expect a glowing review after resigning, did you? Not even back home would that happen - although, back home, they'd be more succinct and subtle).

 

Just be glad you got it, and if your new school has already hired you, and knows about the old school and all... then it doesn't matter!

I did expect a report which detailed what I have done, i.e. something to do with my professional conduct, planning and preparation abilities as this letter damaged my hopes of a smooth transition to my uni. The general adjectives was average/poor which did not reflect my contribution. I expected good as I don't see what leaving 6 months early has to do with your professional conduct and planning. I suppose you're right in one way it doesn't really matter as my uni will still accept me, hopefully but that's not the point. The point is that my record in the psb has a letter which does not reflect what I have done. The other reference letter already states the I worked there for 6 months so that is already on record. The RL is about your conduct and ability, at least that's my understanding and this did not reflect all my hard work. I am glad I eventually got the RL but shocked to find its contents. Maybe I am still naive regarding this country and the system.

Yep - naive! In that, you have (somehow unfathomably to us) made someone 'lose face', and thus, revenge is required!

 

You expect professionalism, fairness, integrity.... you've come to the wrong country.

 

However, for the most part, the rest of the country also knows this, and so the PSB having this bad letter is pretty meaningless - unless you do something so bad that someone needs to drag it back up again. Just let it go, and know that's how this place operates.

Hey SB, long time np hear. Guess what? I have let it go and am working in another famous private language school. The upshot is that HR actually sent my FEC to the PSB but was actually on the desk in the PSB when my new HR called to tell them to cancel the cancelation. Therefore, my previous HR sent it to be canceled out of spite just because I left 6 months into the contract (still didn't do anything wrong, according to the contract- however, I did- I left 6 months early.

So boy do I feel lucky not having to do a useless, but good for the Chinese economy, HK run but annoyed!!! for not getting the flight reimbursement. Still, trying to move on and get on with living. Yes I suppose I was a little naive thinking I could do this but it all goes down to experience.

You haven't really given the context as to how you left. You should bare in mind that it will be a very busy time for the HR. All the new teachers residence permits are being provess. If you screwed them by quiting at a really bad time they will not see your paperwork as a high priority and will obviously be organising the paperwork of people who work for them first.

Hi,  I originally signed a year contract with my (ex)school and fully intended to fulfill that. However, I obtained a post in a university after a few months. I discussed this with HR and they were not too pleased. I apologized for any problems I may have caused.
