Q: I have a Z visa valid till September, and the contract ends in November

My employer said they'll renew the visa easily in September, but as far as i know the visa is based on the contract duration, so they may rather create new contract for the visa renewal purpose, is that right ? Should i expect the new contract that will be valid for longer period of time from them without my agreement or it's possible to renew Z visa for just few months longer without changing the end date of the contract (26 November) ? I want to leave such the employer before September, any suggestions how can i do it legally? I mean if i break the contract - i'm sure i have a very small chance to get release letter from them, so if i rather don't get release letter but i want to apply for a new employer, how can i do it without getting banned from country by breaking the contract with a tricky employer ? Maybe it's still possible to leave country somehow and cancel your visa/resident permit without notifying employer(actually it's recruit agency), then at least i don't need to pay any penalties or whatever agency can require to do ? Then i can just go through all the application process for new Z visa with the new employer over again in the home country ?

No! Don't contact SAFEA!

 

A long time ago, an employer swore on their honor to provide me with a steel kettle, "we'll provide you with a steel kettle" they declared, solemnly.

 

However, I was provided with a kettle made presumably of a different material. "This isn't steel!" I shouted in a loud voice to no one in particular.

 

In a confident but angry fashion I set off at once to the president's office, kettle in hand. I showed him the contract which specified the type of kettle, he could do nothing but shake his head rudely. In an instant I found myself outside the office once again, staring down the empty hallway...alone.

 

Hurriedly, I rushed back to my apartment to call SAFEA, who swore they would resolve the issue. "They'll save the day!", I declared slyly to a local shopkeeper. The man looked back at me, puzzled by my outburst, but with a knowing glance I was off to meet the SAFEA representatives. 

 

Upon meeting them, their demeanor had changed. Glumly, they told me the kettle was adequate. "This is a fine kettle for the likes of you, boy!" they shouted in a contemptable fashion. Further, the employer had made a deal with them that in order to know my place better I had to stand in front giving out flyers to people on the street. When I was finished I had to spend 7 days in a local facility. At this facility they cut off two of my toes before allowing me to work again.

 

"Bummer!" I shouted in a loud voice.

 

So yeah definitely don't call SAFEA!

I'm glad the story went over well though. I really tried to paint a picture of the sights, sounds and feelings of this awful event.

It happened to me in Henan in June this year. Contract was valid till the end of August, but I got RP only till the end of June (end of Semester).

We signed new Contract on June 15th, and as soon we got FEC back from FEB, we extended RP at PSB till June 2016 (end of the Contract).

However, I 'lost' two Summer salaries with that. 

 

It looks, it's on the whim of PSB. Contract validity doesn't matter anymore.

 

If you don't want to renew Contract, you must find new RPermit sponsor/new job before that.

Your present school must take you to PSB before the expiration of RP. You'll get 30-days RP extension, so your new employer will have time to apply for new FEC, and extend RP till validity of new Contract. You don't need to exit China, and apply for new Z.

 

You can also call FEB (SAFEA) for detailed info on proper procedure.

What about the release letter and visa cancelation ? These are two documents required to show off when applying for the new employer, otherwise there's no other way than get back home for the whole visa procedure over again

If you complete the Contract, employer is required to issue Release letter and FEC Cancel Certificate in 30-days after your last working day. ------> Chinese law.

 

You can resign only if your employer doesn't respect the Contract.

Under this 'resignation condition', you're entitled to receive both documents in 30-days after your last working day, but most likely you'll need SAFEA's help at docs. retrieval, if you submit Resignation notice.

 

If you just walk away, prepare yourself for exit from China, and new Z application, probably at your home Chinese Embassy.

I have been in a similar situation for the past few years. Your employer uses a standard contract to get your FEC processed then sign a "real" working contract at some later date. As always a contract is flexible for the employer and not so flexible for us.

 

Rather than going the SAFEA track which is bound to get you off-side with your company who may then make things difficult for you, why not just talk to them and explain your situation. You may be surprised that they will cooperate and end your relationship at the end of your permit. I have chosen to do this in the past and everything has worked out in the end.

 

Some 'poetic licence' may be in order when you present your side of the issue. Needing to go to your hometown for a sick parent will expedite most issues in your favour....your colleagues almost certainly use this gold nugget when they want an unsheduled holiday. Shhhh!

By the way, i just found, The office of Jilin SAFEA is like one bus stop away from the office of my recruit Agency. They must be known each other for decades already )

Phone call is better, 'cause they don't check emails too often. I usually call them and ask for agent's email address. Then, I send an email with detailed explanation of the problem.

Yeah, Definetaly i'll try to go this way first, then depends on their answer... I've meant that i wanted release letter from them to apply for another employer without turning back home. Anyone can guess what is the possibility to get release letter by breaking the contract earlier with this kind of tricky employer ?crying

i dont know, I worked for one school 5 years ago, then broke the contract to take a job in another industry in a different province. Been here ever since.

 

I have no idea what the release letter means to getting a new job. Sorry
