Q: If a couple is married only one month (less than 24 months) can they get a legal no fault divorce?

If  a couple has been married only 1 month can they  get a legal no fault divorce in China.?

 

Or do they file a legal seperation decree / live by the decree / and file for divorce 1 or 2 years after?

 

IF a couple is married less than 24 months can they file for a no fault divorce?

There's no such thing as annulment here in China (unless it can be proved that one party was either forced into marriage or underage at the time of marriage).

 

You can get a no-fault divorce, but only through the courts and only after at least a year of separation (two years separation, if proven, can lead to an automatic divorce whether both parties agree or not).

 

Been there, done that, she got my t-shirt.

Are you sure we have to wait a year?

I would surmise that the court would want to know your motives for marrying in the first place more so than the reasons for divorce. But, I'm not the judge.

Well I got the divorce at the same place I got married. no problem/ no explanation/just both parties agree and have no issues. Cost a little over 400 rmb in about 30 minutes.in Liaoning Province.
