Q: If I get a new job, do I need to leave the country for new Z visa?

I am residing in Guangzhou,China on spouse dependent residence permit.If I get a job,should I leave the country and reapply for Z visa in the country of my origin(with work permit&visa notification etc) or it can be done in China itself? Pl help.

I'm pretty sure you would have to leave the country if you get a visa. Chances are, though, you might not have to go back to your home country, but might be able to transfer your current visa to a Z visa, depending on what company you work for and whether or not they can help you.

Fact: While being married to a Chinese citizen will grant you the ability to apply for a year long visa, the visa type is still L (tourist), which means you’re not legally allowed to work on this visa. China is still a long ways off from giving foreign spouses the full benefits of permanent residency. In order to qualify for permanent residency by relationship to a Chinese citizen you must live in China as a tax payer, with a residence permit, for 5 years after marriage. Even if you meet these requirements, the Chinese government issues relatively few permanent residency cards and most of these tend to go to foreigners with financial ties to China rather than personal ties.

The question is....what is your nationality?

Where you process your working visa depends on your nationality. Because some nationals go home the others can just do it right here.

What he or she said above is true. Guangzhou is not on the list of 4 that require all foreigners to go home no matter the nationality. They include, Shenzhen, Beijing, Tianjin and Shanghai. This is up to date as of last week when I checked for a friend in Tianjin. Depending on where you are from you should be able to go to Hong Kong for a Z visa. As of now, as long as you are not from a country well known for terriost activity, your future employeer needs to apply for an expert certificate, first with a medical from an appointed medical facitliy, after this they will give you a letter of invitation, a copy of your Foreign Expert Certificate and your medical papers to take to the Chinese Embassy in Hong Kong. You will fill out the entry exit paper while requesting a Z visa. Call the PSB of Guangzhou to verfiy if you can go to Hong Kong. Because of the many applicants for visas to China, expedited services are no longer allowed so expect a five day trip, keep in mind of Chinese hoildays. If you do have to go back to your Home Country, do not worry, it can literaly be done in one to two hours for a few extra dollars and be on a flight back to China the same day.

I guess feilang is an employee at ilaowei...nice way of advertising and I stand with the gentleman on every word he said. It's true people. They can really do it and I personally know Mr. TIm, the founder of ilaowei, quite a nice man.

However, I must warn you guys to stay away and watch out for agents that would try to suck you dry like a vampire. I remember a friend of mine had trouble dealing with a visa agency known as Best Partners around DongFeng Zhong Road at Yuexiu District right here at guangzhou. I was told that the owner is married to a russian lady and was an ex-immigration officer. Now I really don't know if he really was an ex-immigration officer but whatever he did to my friend was completely illegal. The guy has a very classy office with many female staff that speaks chinglish so beware, I suggest you not to go there at all and if you know anyone, warn them too cuz the guy really is a blood sucker. He may seem a nice guy from outside but from the inside, he's totally a hypocrite, liar and really knows how to threaten with laws in China.
Laws in China may be a little complicated but the basic law is the same. As long as you don't break their law, you are good. Wink

About the working visa, find a good agent and they'll handle your stuff. Don't worry about it as long as the agent doesn't rip you off. Cool

I don't know the answer but i will like to say something about one of the comments because in my opinion is important.

It is not true, i am married with a Chinese citizen and i go to the emigration office for the yearly L visa, they don't put me a visa in the passport anymore, they put me the residence permit directly (i used the L visa since 2007) now in 2011 in May they give me residence permit BUT on the permit (which is stick to one passport page) it is writing that i am NOT allowed to work....so no more L visa for married foreigners (at least in Guangzhou)...

To Adrian O and those who are concerned about visa benefits after marrying to a chinese lady!!

I came to China on a working visa and have worked in my places and currently have my own business law firm for almost 6 years, however, I have friends who are married to Chinese and lived in China for longer than I did and when they changed to married visa, the benefits they gained were as follows:

1- No more paying tax whether you own a business under your name or her name but it would depend on what kind of business you own.
2- You may have to pay a little tax if you plan to open a WOE (Wholly Owned Enterprise) but once again, you won't have to go through a lot of hassle while opening the WOE. Just the basic documentary requirements.
3- You will be somehow treated as a Chinese citizen and according to some friends, the Chinese government may by chance issue you an official Chinese ID card after 5-6 years of your marriage life, that's ofcourse provided that you keep your wife happy, financially and mentally.. and don't forget, materialistically too...
4- You will have to abide the Chinese law more strictly more than the other foreigners such as not more than one child and if you do, then, you will need to pay,
5- You won't be able to get out of China more often. Your maximum entry is 4-5 and in some cases 6 entries.
6- You may work wherever you want excluding government field and it may exclude banks too they don't trust foreigners...hehehe lol!
7- You will still need a visa to travel to HK unless if you are not from a third world country though some countries in the 2nd world countries are worse than the worst country in the third world yet, they are blind to tell the differences.
8- Applying for pension, driving license, social security, life insurance and green card of HK will be easier, however, applying for European visas won't be easy. Anyways, it's never easy..hehe
9- Assuming that things don't work out with your Chinese wife, then, note that you'll lose everything including your child or children
10- Lasty, not least, considering that you follow the above mentioned, I still suggest everyone that who ever has whatever visa, they are better than married visa because I'm sure nobody wants strings attached and treated like a puppet.

My kid is Chinese citizen so it is normal to "lose" him since i am not a Chinese citizen, as for the others things you mention i keep the money in Hong Kong and about houses or other proprieties in China in case of divorce you will get half in the court so other then the kid you don't lose nothing, but also in the case of the kid there are solution's but i cannot write here...

10. What do you mean by "treated like a puppet" ??? For me personally there is no difference between the L visa or the residence permit i have now.

Somehow you was married in China and now you are divorced ??? or are living in China?

1. Residence permits do not have limits on the number of entries and exits, holders can exit and enter Mainland China for many times during its validity, it saves time and money.
2. The Family Visit Visa/Residence Permit can be extended when it expires.
3. Holders of this Family Visit Visa/Residence Permit are not allowed to work in China

I've had it go both ways.  Only once I was asked to step out of the country (quick jaunt to south korea)  but three times i was allowed to stay.  I just was really really polite to the officer at the PSB

I have heard of some people who did not have to go back. I have no idea why. Most people seem to have to fly home for it. Maybe an agency can help with this, but I guess it is just luck, like most things with the Chinese government.
