Q: Is it possible to live in china on expired visa ?

is it important to have some company or any local body to process you visa
is the sponsor very important in china.if you are living in china on an expired visa what are the possible penalities if you are caught ?

Ryan,

Just turn yourself in.  Fines, deportation, jailtime, blacklisted from future visas.  It's all worse if you wait till they catch you.

It's possible... but you're gonna get in trouble if you get caught on the street or when you decide to leave. Do as DaBen said, and turn yourself in and plead, beg, cry for mercy. And maybe pay em off Wink

how long u have been living without visa???

u'll have to pay a huge fine... its rate per day... so if u r too long.. u r screwed..

If you turn yourself in now,you'll be able to work it out if you are over by 6 months. I've seen it and the guy was only deported without being able to reenter for 90 days, if you go up to a year, it's over. Take at least 30,000rmb with you, not for the fine but as pay off.

If you don't have connections (as in guanxi), then it is going to be very, very tough. Try boarding a plane, train, or checking into a hotel without a passport with a valid visa inside. Better yet, try purchasing a ticket without same. These places check regularly.

It's called "abiding by the rules." Yes, situations do happen, but it is up to you to make sure that they don't. Be a responsible adult and turn yourself in, because delay will only make the situation worse.

All the folks here (and on your other post) have given you good advice, and told you the truth. To ignore it now just means you'll have to deal with the consequences, which at the very least would be a massive fine, deportation, and being put on a black list. We don't want to talk about worst case senarios!

Once I left a bar and drove home. I was sitting at a stop light, and a very drunk girl hit my car from behind going really fast. Both were solid SUVs, and we got lucky, and no serious injuries. I was looking at two destroyed cars and I asked some guys that were sitting at a light "guys, i think ive had enough to be over the limit, what should I do?"

There response only proved that they were also over the limit. "You should push you car to the side of the road, go home and call the police and say your car is stolen."  I said "I have to call the police dont I?" They said yes and drove off.

I knew I might get in trouble, and I knew it could be bad, but I also knew the only thing to do was to call the police.

That story ended well actually because I did the only logical thing. I wanted a magic solution but they dont exist. And in this case, you are in the same way, you have to just do what is necessary and hope for the best.

Thank you everyone, but please please this is not my post, but still really helpful advices. However, paying the fine and the ticket and some other expenses at the same time, it is not possible at this point. I am not asking for magical stuff to happen I am asking for sensable way out. Which in other words trying to bend the laws not breaking it. Because once I will leave china I will not try to come back. I already have a very bad experiance, and to be very honest this is not the place to be, unless I have an American passport with me. Thats a shock. Anyways, Im looking for some different ways to clear this situation in a different way I am not sure how but differently. I know it is getting worst, but what other choice I have at this point? it is already over six months, 

never mind nothing is usefull here I cant even get a job or go to university to countinue my studies. Just sit at home and do nothing. Just trying to stay away from the JAIL. I have kept my self away from Jail or any bad records then I am not going to let this so called university issue stamp me. NO way not at all.

 whoever is asking question about visa or student visa dosnt mean its me, so please give them advice according to there question. Because they have different issues and requeirments.

Yes, it is possibe to live in China with a expired visa, but when caught (and you will be, sooner or later), you will not like the consecuences.

The penalties could vary, from a fine, a letter of warning to your record, giving you 10 days to leave China voluntarely, to jail time and then forced deportation, plus no further chances to enter China again either in a number of years or forever.

The actual cash fine is 500 Rmb per day, up to a maximum of 5,000 Rmb.

And for your information, the longer you wait, the worse the consecuences will be, for you, and for all of the other ExPat community living in China.  Becasue of your actions, our life will suffer due to further excrutiny and lots of more difficulties in getting a visa, or an extension for an existing one.  People always remember the bad apple, all other apples in the barrel, who behaved according to Law, and showed respect, are soon forgotten.

And for Ryan123 :  You must excuse me for not believing your claim.  But there are too many questions exactly on the same subject, asked in a slightly different way each time, to be a coincidence. 

And again, my advise to you.  Either swim into Hong Kong so you avoid exiting China, plus all penalties included and future consequences, or turn yourself in tonight.  For each passing day you wait, your chances to be caught increases, a neighbor may call the Police on you, your former university may call the Police, or just be caught because it was not your day.  And it is worse to be caught than to turn yourself in.  But do as you please, just do not cry afterwards.  Sitting at your aparment waiting for a magic solution to materialize is not the right way.  Be a man, face the consecuences of your actions.

You say you don't have enough money to pay the fines and you don't have a job?  So it seems you will never have the money.  I strongly urge you to listen to the good advice.  Contact a family member in your country to send you money or appeal to your consulate.  I'm sure this has happened to others before and maybe they can work out a solution so you can exit the country, but believe me (and the others):  This can end only one way.  You can do it the hard way (turn yourself in) or the much harder way (wait and do nothing).  You really have no other choices.

Living in China illegally is not a good idea at all, unless you are already in this situation, but if it is just the start like weeks then you can fix it with a very little amount of money, but it really depends on the passport you are holding. So my advice try your best to fix it. If it is not too late you can go online on Shenzhenparty.com in visa section or you can search for visa services they can for sure help you, but once again it all depends on what passport you are holding. Top visa agents they preffer working with American,British or Australian passport holders usually besides these it is bit hard to find any help.

i had a similar situation in Ukraine

i thought the visa validity duration is the duration of stay so i overstayed my visa by mistake

i tried everything: lawyers, visa agents, finding jobs and nothing helped

the effective way was that i asked my family to send me money to buy a ticket home and send me some cash to pay the penalty

i went to the airport and paid the penalty and asked them to have mercy because it was an honest mistake and they actually did let me go without blacklisting me or anything

i suggest the same : go and turn yourself in
