Q: joint venture partnership

How easy is it to set up a joint business venture with a local Chinese?  What kind of Visa do you get after you've set up this venture?  and what does it allow you to do??  If anyone can help with any information ..please do, much appreciated.... I was wondering if this process would allow me to be a freelance musician/entertainer in China, albeit I would have to give my pound of flesh to someone !!!!

Since the Chinese partner will be the majority owner by law, things will be easier than if a foreigner tries, less red tape.

As a minority owner, you can get a work visa, and a work permit, FEC and residence permit if fulfill requirements.  That will allow you to work in the partnership, and reside in China for periods of one year, renewing it each year as long as the partnership exists.  Maybe the first one could be for 6 months, the rest for one year, and after 5 years may get a 2 year permit.

As far as freelance, unless the partnership is hired, and you go an perform, and the partnership gets paid, you could do it.  By yourself, even with a work visa, no way Jose,  because your visa is tgie to your employer (the partnership).

I've been looking at this, and I don't recall anywhere that said the local person needs to have majority share. I thought they did, but have since read otherwise...

 

Also, once you set up your business, you should be able to get an F visa... not sure of whether that will help you or not...

it's not easy for Joint Venture.. Sino party shall be a company. foreign  part shall be company or individual. 

 

it takes a lot of time to establish at least 2 and half month. 

 

my advice shall be wholly foreign own enterprise. It requires a lot of documents. it depends on what kind of industry do you do.

A WOFE (whole own foreign enterprise) is a lot harder to do, since it does carry much more red tape and documentation. A Joint Venture may take a couple of months, a WOFE will take at least 6 months, and a minimum of 100,000 yuan deposited in a bank account as capital.

Where do you set up WFOE in China for taking 6 months? it is crazy........

 

The most process time i heard in CHina will be 3 months-4 months.

At least in Nanning, Guangxi Province. They kept on requesting another document, then to bring back original to check it vs the copy they had, a new permit, show from where capital money was obtained, etc. Oh, and inspectors for the different permits where another basket case, always asking something else to be corrected until a bribe was produced. I have no idea why they can not give you "all" the deficiences found during the first visit, and not piecemeal at the rate of one per visit. Even the Chinese banister was extremely upset with the run around received. But once I had it, it was well worth it.
